Permit fees and fees for applications for development shall be waived for persons having disabilities to the extent permitted by Chapter 92 of the Public Laws of 1996,[1] for improvements to the dwelling unit of a person having a disability which promote accessibility to that unit.

As used in this article, the following terms shall have the meanings indicated:
DISABILITY
The same meaning as set forth in Public Laws of 1996, Chapter 92.[1] The Administrative Officer or Code Enforcement Officer shall refer any question regarding disability to the Board of Health. A person engaged in substantial gainful activity shall not be considered as having a disability.
