It shall be the duty of the Corporation Counsel, when requested so to do, to defend any and all civil actions brought against any member of the Fire Department for damages on account of any act committed by him in the performance of his duties as such member, provided that it shall not be the duty of the Corporation Counsel to defend any such member when charges are preferred pursuant to statute against him for neglect of duty or misconduct in office.
