An appeal to the Zoning Board of Adjustment may be taken by any interested party affected by any decision of the Administrative Officer of the municipality based on or made in the enforcement of the Zoning Ordinance or Official Map. Such appeal shall be taken within 20 days by filing a notice of appeal in the manner set forth in Article II, § 63-19A, of this chapter and in accordance with the provisions of Article 9 of the Municipal Land Use Law of 1975.[2]

An appeal from any decision of the Zoning Board of Adjustment granting a use variance pursuant to the provisions of N.J.S.A. 40:55D-17d may be taken to the governing body, provided that such appeal shall be made within 10 days of the date of publication of such final decision of the Zoning Board of Adjustment.
An appeal from any final decision of the Zoning Board, other than an appeal of the type described in § 63-37 hereof, and any appeal from any final decision of the Planning Board may be taken to the governing body, provided that such appeal shall be taken in accordance with N.J.S.A. 40:55D-17.

All applicants who have filed notices of appeal from the Zoning Board of Adjustment and/or Planning Board to the Municipal Council of the Borough of Lodi shall be required to obtain, pay the cost therefor and file with the Municipal Clerk 10 copies of the transcripts for use by the Borough of Lodi in its appeal hearing.
