The International Property Maintenance Code, 2006 edition, as published by the International Code Council, be and is hereby adopted as the Property Maintenance Code of the Borough of Lodi, subject to the additions, insertions, deletions and changes, if any, prescribed in §
407-2 of this chapter. (A full reprint of the Property Maintenance Code of the Borough of Lodi is on file in the office of the Borough Clerk.)
The following sections are hereby revised:
A. Section 101.1. Insert: Borough of Lodi.
B. Section 101.2. Delete "life safety, safety from fire and other hazards"
(these areas are covered by other applicable state and/or local codes).
C. Section 103.1. Substitute "Division" for "Department" and "Property
Maintenance Officer" for "Code Official" in this section, and wherever-after
appearing; insert "a division of the Zoning Department" after "property
maintenance inspection"; and insert "shall be the Zoning Officer.
The Zoning Officer or his designee" after "executive official in charge."
D. Sections 103.2 and 103.3. Delete.
E. Section 103.5. Replace with: "There shall not be any fee for an initial
inspection by the Property Maintenance Officer. However, if a violation
is issued as a result of any inspection, there shall be a fifty-dollar
fee, payable by the property owner (or if a rental property, by the
tenant thereof if the tenant is the responsible party), for each reinspection
required. Such fee shall be in addition to any fine levied or imposed."
F. Section 106.4. Add: "For the offenses listed in Sections 302.4 (Weeds)
and 307.3.3 (Garbage and recycling disposal times), a fine of $75
is hereby imposed for the first offense and $150 for a second offense
(occurring within one year or less of a second offense) and $300 for
a third offense (occurring within two years or less of a second offense).
All other offenses shall be set by the Municipal Court."
G. Section 107.3. Amend Subsection 2 to read: "Sent by certified and
first-class mail addressed to the last known address; or".
H. Section 107.3. Amend Subsection 3 by replacing "If the notice is
returned showing that the letter was not delivered . . ." with "If
both the certified mailing and first class mailing are returned showing
that the letter was not delivered . . ."
I. Sections 108, 109, 110 and 111. Delete.
J. Section 302.4. Insert: seven inches.
K. Section 302.10. New section: "Whenever any property is undergoing
any repair, construction, maintenance or demolition that results in
open pits, basements, pools, holes or other similar hazards, or during
the course of demolition or construction, or where there are hazards
accessible to the public, or in any other circumstance where, in the
sole opinion of the Property Maintenance Officer, causes or could
cause an imminent danger to any member of the public or any adjoining
property owner, said property or portion of such property so described
shall be fully enclosed in order to prevent access to said area. Such
enclosures shall be a fence or other barrier at least 72 inches (1,829
mm) in height above the finished ground level, similar in strength
to conventional chain-link fencing. Gates and doors in such barriers
shall be secured whenever the property is vacant. Snow fence, chicken
wire or similar types of barriers may not be used."
L. Section 304.14. Insert: May 1 and October 15.
M. Section 307.3.3. New section: "No rubbish, garbage or garbage container,
or any recycling material or container, shall be placed on the curb
for disposal earlier that 6:00 p.m. of the night preceding the premises'
normally scheduled garbage or recycling pickup."
N. Section 602.3. Insert: May 1 and October 15.
O. Section 602.4. Insert: May 1 and October 15.
