There shall be imposed an annual license fee in the amount of
$5,000 per year upon any authorized recreational marijuana retail
facility located in the Borough that is permitted and approved by
the Borough and licensed by the State of New Jersey Cannabis Regulatory
Enforcement Assistance and Marketplace Modernization Act N.J.S.A.
24:6I-31 et seq. ("CREAMM").
The annual license fee shall be paid no later than January 15
of each calendar year commencing in January 2023.
Upon payment of said license fee to the Borough of Lodi, the
license shall be issued by the Borough Clerk to the facility conditioned
upon compliance with all other laws, rules, regulations, ordinances
and statute. The license issued shall be conspicuously displayed on
the premises of the facility. Said license shall be produced and exhibited
at any time at the request of a police officer or any other person.
In the event any section, part or provision of this chapter
shall be held unconstitutional or otherwise invalid by any Court of
competent jurisdiction, such determination shall not affect the validity
of this chapter or the remaining provisions which shall remain in
full force and effect.
All parts of ordinances which are inconsistent with the provisions
of this chapter are hereby repealed to the extent of such inconsistency.
