The Chief of Police of the Borough of Lodi shall recommend to the Municipal Council his approval or disapproval of the application for any license herein provided for, basing his decision on the need of the public for taxicab service, the number of taxicabs in operation and the anticipated future demands, and the interest and welfare of the Borough.
The licenses herein provided for shall be signed by the Borough Clerk and shall have the Borough Seal affixed; provided, however, that no licenses shall be granted except upon full compliance with all the provisions of this chapter and after approval by the Municipal Council.
The Borough Clerk shall keep a numerical register of all licenses granted under the provisions of this chapter, which register shall show the character of the license, its number, date of issue, name of person licensed, the amount of fee collected and any other information pertaining thereto; and he shall keep all applications; and upon those which may be granted, he shall endorse the number of the license issued in pursuance thereof.
All licenses granted hereunder shall expire on the 31st day of December succeeding the date of issue. Each applicant shall pay the full annual license fee as provided, and there shall be no proportional abatement of the license fee for any license fee issued after January 1 in any year.
The Municipal Council may suspend or revoke any license issued hereunder for the violation of any of the provisions of this chapter or for the violation of any of the rules and regulations made, adopted or promulgated by the Municipal Council, which rules are adopted by the Municipal Council in accordance with the provisions hereof. Any such suspension shall be noted on the license, together with a statement of the reasons therefor, and the driver shall be deprived of his badge by the Police Chief suspending or revoking such license; the badge to be returned at the expiration of the period for which a license was suspended. A second suspension for the same reason or, in any case, a third suspension of a taxi driver's license shall revoke the license.
Any person, firm, corporation or association who shall violate any of the provisions of this chapter shall, in addition to the suspension or revocation of the license heretofore mentioned, be punishable by a fine not exceeding $2,000, imprisonment for a period not exceeding 90 days and/or a period of community service not exceeding 90 days; a separate offense shall be deemed committed upon each day during or on which a violation occurs or continues.
