A. 
There is hereby established in Alloway Township a State Uniform Construction Code enforcing agency to be known as "Alloway Township Construction Administration," consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official, Fire Protection Subcode Official and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency. Each of the above-named officials shall enforce the code or subcode indicated by his title, subject to the supervision of the Construction Official.
B. 
Each official position created in Subsection A hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217, as amended,[1] and N.J.A.C. 5:23, provided that, in lieu of any particular subcode official, an on-site inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, c. 217, and N.J.A.C. 5:23 to hold each such position.

C. 
The public shall have the right to do business with the enforcing agency at one office location, except for emergencies and unforeseen or unavoidable circumstances.

A. 
The fee for a construction permit shall be the sum of the following:
(1) 
The building subcode fee shall be:

(a) 
For new residential construction (Use Group B, M, and R): $.034 per cubic foot of building or structure volume, provided that the minimum fee shall be $50.
(b) 
For new agricultural construction: $.001 per cubic foot of building or structure volume, provided that the minimum fee shall be $25 and the maximum fee shall be $1,443.
(c) 
For new commercial or industrial construction (Use Group H, I, F, and A): $.027 per cubic foot of building or structure volume, provided that the minimum fee shall be $50.
(d) 
For new detached structure ancillary to a dwelling or for outbuilding construction (Use Group U, S1 and S2): $.019 per cubic foot of building or structure volume, provided that the minimum fee shall be $25.
(e) 
For renovations, alterations and new aluminum, vinyl, or steel siding or new siding of any kind: $10 per $1,000 of estimated cost of the work, provided that the minimum fee shall be $25.
(f) 
For residential additions: $.034 per cubic foot of building or structure volume for the added portion, provided that the minimum fee shall be $50.
(g) 
For agricultural additions: $.001 per cubic foot of building or structure volume for the added portion, provided that the minimum fee shall be $25.
(h) 
For combinations of renovations and additions: the sum of the fees computed separately as renovations and additions, provided that the minimum fee shall be $50.
(i) 
For aboveground swimming pools: $63 per pool.
(j) 
For in-ground swimming pools: $100 per pool.
(k) 
For removal of home heating oil tanks up to 2,000 gallons: $50.
(l) 
For removal of home heating oil tanks above 2,000 gallons, or any commercial tanks, including, but not limited to, heating oil, gasoline, or other underground storage tanks: $100.

The plumbing subcode fee shall be the amounts set forth for the particular items and work in the schedule of department fees in N.J.A.C. 5:23-4.20, provided that the minimum fee shall be $60.

(3) 
The electrical subcode fee shall be the amounts set forth for the particular items and work in the schedule of department fees in N.J.A.C. 5:23-4.20, provided that the minimum fee shall be $60, with a flat fee for swimming pools of $69.

(4) 
The fire subcode fee shall be the amounts set forth for the particular items and work in the schedule of department fees in N.J.A.C. 5:23-4.20, provided that the minimum fee shall be $60.

(5) 
The fee for plan review shall be 25% of the amount to be charged for the construction permit and shall be paid before the plans are reviewed. The amount paid for this fee shall be credited toward the amount of the fee to be charged for the construction permit.
(6) 
The fee or a permit for the removal of a building or structure from one lot to another or to a new location on the same lot shall be $5 per $1,000 of the sum of the estimated costs for moving, for new foundations and for placement in a completed condition in the new location, provided that the minimum fee shall be $50.

(7) 
The fee for a permit to construct a sign shall be $0.50 per square foot, measured on one side of a double-faced sign, provided that the minimum fee shall be $25.

(8) 
The fee for occupancy permits shall be $50.

(9) 
The fee for a permit for demolition of a building or structure shall be $40.

(10) 
The fee for continued occupancy permits for existing building not subject to construction permits shall be $50.
(11) 
The fee for a zoning permit shall be $75.[1]

The fee for a temporary certificate of occupancy shall be $25.

The fee for a continued certificate of occupancy shall be $75.

B. 
The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Township Committee of the Township of Alloway, biannually, a report recommending a fee schedule based on the operating expenses of the agency and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act.
C. 
Surcharge fees.
(1) 
In order to provide for the training, certification and technical support programs required by the Uniform Construction Code Act and the regulations, the enforcing agency shall collect, in addition to the fees specified above, a surcharge fee of $0.00334 per cubic foot of volume of new construction. The fee for all other construction shall be $1.70 per $1,000 of value of construction. Said surcharge fee shall be remitted to the Bureau of Housing Inspection, Department of Community Affairs, on a quarterly basis for the fiscal quarters ending September 30, December 31, March 31 and June 30 and not later than one month next succeeding the end of the quarter for which it is due, in conjunction with report number R-840B State Training Fee Report in accordance with N.J.A.C. 5:23-4.5(e). In the fiscal year in which the regulations first become effective, said fee shall be collected and remitted.

(a) 
No fee shall be collected for preengineered systems of commercial farm buildings.
(b) 
No fee shall be collected for permits to perform asbestos abatement or lead abatement.
(c) 
No fee shall be collected for permits for the construction or rehabilitation of residential units that are to be legally restricted to occupancy by households of low or moderate income, as defined in N.J.A.C. 5:43-1.5.

(e) 
No fee shall be collected for work consequential to a natural disaster when the local code enforcement agency is waiving its fee.
(f) 
The minimum permit surcharge fee shall be $1.
(2) 
The enforcing agency shall report annually at the end of each fiscal year to the Bureau of Housing Inspection, and not later than July 31, the total amount of the surcharge fee collected in the fiscal year.
