[Adopted 2-26-2002 (Ch. 2 of the 1966 Code)]
Certain offices of the Borough shall be filled by appointment unless otherwise specified. Such appointments shall be made by the Mayor, with the advice and consent of the Council, including the filling of vacancies, which shall be for the unexpired term only. The method of appointment shall be as provided in N.J.S.A. 40A:60-5 and 40A:60-6. The term of each office shall be as provided by statute and Borough ordinances.

A. 
Office created. The office of Borough Administrator is hereby created in and for the Borough of Raritan pursuant to N.J.S.A. 40A:9-136.
B. 
Other titles held. The Borough Administrator may simultaneously hold other titles of Borough employment, provided that all requirements are met.
C. 
Powers and duties. Subject to recall by ordinance by the Borough Council, the powers and duties of the Borough Administrator shall include the following:
(1) 
He shall act as a liaison between the Mayor, the Borough Council and all boards, departments and officers of the Borough.
(2) 
He shall be responsible for the maintenance of sound personnel policies and administrative practices and shall study and make recommendations with respect to the personnel organization and policies of the Borough and any of its departments after consultation with the Mayor and with department heads.
(3) 
He shall have direct supervision and control over all clerical and secretarial personnel employed by the Borough.
(4) 
He shall aid in the preparation of the budgets; alert the department heads to the submission of their portion thereof; and shall assist Council persons in contributing their share of the responsibility for the municipal budget.
(5) 
He shall study and oversee the financial procedures of the Borough and its departments after consultation with department heads and with the Chief Financial Officer of the Borough.
(6) 
He shall investigate all complaints regarding Borough services and, after consultation with the department head of the service involved, shall answer same and report the disposition thereof to the Borough Council.
(7) 
He shall act as agent of the Borough Council by conducting the general affairs of the Borough, including purchasing, administration and enforcement of contracts, leases and franchises.
(8) 
He shall perform such other duties as may from time to time be specifically assigned to him by the Borough Council.
D. 
Limitation of powers. Notwithstanding anything in Subsection C hereof contained to the contrary, the Borough Administrator shall not exercise any powers or perform any duties required by law to be exercised or performed by the Mayor, the Borough Council, or by any other Borough board, body or officer.
E. 
Compensation. The Borough Administrator shall receive such compensation as shall be prescribed by the Salary Ordinance of the Borough of Raritan.
A. 
Appointment, qualifications and compensation. The Mayor, with the advice and consent of the Council, shall appoint a Borough Clerk for the term prescribed by law. Prior to the appointment, the Borough Clerk shall have been qualified by training and experience to perform the duties of the office. The person shall serve as the Clerk of the Council and shall have such other functions, powers and duties as provided by law. Such person shall acquire tenure upon being reappointed as Municipal Clerk, subsequent to having served as Municipal Clerk for not less than three consecutive years immediately prior to such reappointment. The compensation of the Borough Clerk shall be as set forth in the annual salary ordinance.

B. 
Employees in the office of the Clerk. The number and type of employees in the Borough Clerk's office shall be determined by the Mayor and Council.
The Borough Attorney shall be appointed by the Mayor with the advice and consent of the Council, but need not serve full-time and shall be compensated by such retainer or other agreement as shall be approved by the Council. He shall serve for a term of one year as provided by N.J.S.A. 40A:9-139.
A. 
Appointment. The Municipal Engineer shall be appointed by the Mayor, with the advice and consent of the Council.
B. 
Qualifications. To be eligible for appointment, the appointee shall hold a degree in civil engineering from a recognized college of engineering and shall be licensed in the State of New Jersey as a professional engineer.
C. 
Duties. The Municipal Engineer shall perform the duties as required by law in the ordinances of the Borough of Raritan.
D. 
The term for the office of Municipal Engineer shall be for three years pursuant to N.J.S.A. 40A:9-140.

A. 
There is hereby created the position of Purchasing Agent for the Borough of Raritan.
B. 
The Purchasing Agent shall be appointed by the Mayor upon the advice and consent of the Council.
C. 
The Purchasing Agent is required to possess a valid qualified purchasing agent certificate, as issued by the New Jersey Division of Local Government Services, Department of Community Affairs.
D. 
The Purchasing Agent shall have, on behalf of the Mayor and Council of the Borough of Raritan, the authority, responsibility and accountability for the purchasing activity pursuant to Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., to prepare public advertising for and to receive bids and requests for proposals for the provision or performance of goods, services and construction contracts; to award contracts pursuant to New Jersey law in accordance with the regulations, forums and procedures promulgated by state regulatory agencies; the establishment and enforcement of any and all local purchasing policies adopted by the governing body; the purchasing and claims approval authority of the Borough Purchasing Officer set forth by ordinance; and the conduct of any activities as may be necessary or appropriate to the purchasing function of the Borough of Raritan.
E. 
Having appointed a Qualified Purchasing Agent pursuant to N.J.S.A. 40A:11-9, the Borough will take advantage of the higher bid threshold (currently $36,000, with a quote threshold of 15% or $5,400), pursuant to N.J.S.A. 40A:11-3a, as such threshold may be adjusted from time to time pursuant to N.J.S.A. 40A:11-3(c), but may at its discretion go to bid at a lower amount to encourage greater competition among bidders.

The Borough of Raritan hereby creates the position of Tax Collector pursuant to N.J.S.A. 40A:9-141 to carry out the responsibilities set forth under N.J.S.A. 40A:9-141 et seq., as amended. The term of said Tax Collector shall be as provided by law.
