A. 
All ashes, garbage and other refuse matter shall be properly disposed of as promptly as possible by every owner, tenant, housekeeper, merchant, clerk, innkeeper, servant and every other person who may have control of the same.
B. 
Removal of building materials and refuse matter from building operations and building construction, repairs and alterations shall be the obligation of the property owner and not the Borough.

A. 
All garbage, ashes and other refuse matter shall be kept as dry as possible and shall be immediately placed in a garbage receptacle and kept tightly covered. A heavy-gauge plastic bag having a thickness of at least .80 millimeters may be utilized as a garbage receptacle, provided that such bags are securely fastened so as to allow no leakage or spillage therefrom.
B. 
It is the responsibility of the resident to properly maintain garbage receptacles. A resident shall ensure that a garbage receptacle is maintained in accordance with the following provisions:
(1) 
No garbage receptacle shall be maintained that features serrated or sharp edges, as they pose a safety hazard to Borough waste collectors.
(2) 
Garbage receptacles that have deteriorated bottoms, allowing for potential spillage of wastes, must be immediately replaced.
(3) 
No waste materials exceeding 50 pounds shall be maintained in any garbage receptacle.
C. 
The Borough of Raritan shall have the right to condemn garbage receptacles, not in conformity with this section, through the placement of a condemnation sticker on the can. The Borough of Raritan may remove any condemned garbage receptacle.

Garbage, bulk waste, ashes and other refuse matter shall be placed along the curbline of the street at such times as a notice of the Raritan Borough Council from time to time may require. The garbage, bulk waste, ashes and other refuse matter shall not be set out at the curbline for collection except during the hours of the day or days scheduled for collection, or from 4:00 p.m. through 12:00 midnight of the day preceding such collection, and then shall be placed along the curb and separated as follows:
A. 
All ashes, dirt, dust, soil, and other indestructible waste shall be placed in a separate container which can be easily handled;
B. 
All other waste, garbage or refuse shall be placed in a manner in which it can be easily handled.
All garbage and other refuse matter referred to in §§ 305-3, 305-4 and 305-5 not cared for in the manner provided by above §§ 305-3, 305-4 and 305-5 are hereby declared to be a nuisance, and all owners, tenants, clerks, servants, agents and all other persons who suffer or permit such nuisance to continue upon property owned or occupied by them or any of them respectively or any property adjoining it, after a written notice from the Clerk of the Borough of Raritan, shall be liable to the penalties herein prescribed.

A. 
Any person who violates any of the provisions of this article shall, upon conviction thereof, be subject to a fine not exceeding $2,000, imprisonment for a period not exceeding 90 days and/or a period of community service not exceeding 90 days.
B. 
The Borough of Raritan has the right to remove any garbage receptacle condemned for violation of the regulations set forth in § 305-4.
As used in this article, the following terms shall have the meanings indicated:
