The Borough of Raritan Shade Tree Advisory Board is hereby established.
A.
The Board shall consist of three members appointed by the Mayor and
Council, all of whom shall be residents of the Borough of Raritan.
The members shall serve without compensation. The Mayor and Council
shall designate one of the members to serve as Chairman and presiding
officer of the Board. The terms of office for the first Board members
shall be for one, two or three years, to be designated by the Mayor
and Council in making their appointment, and their successors shall
be appointed for terms of three years.
B.
The Mayor and Council may remove any member of the Board for cause,
on written charges served upon a member and a hearing thereon in which
the member shall be entitled to be heard in person or by counsel.
A vacancy on the Board occurring otherwise than by expiration of the
term shall be filled for the unexpired term in the same manner as
the original appointment.
The Shade Tree Advisory Board shall have the power to evaluate
and make recommendations concerning the regulation, planting and care
of shade trees on public property; the regulation and control of the
use of the grounds surrounding shade trees as necessary for their
proper growth, care and protection; to move or remove any tree or
part thereof which is a danger to public safety; and for the administration
of treatment to or removal of any infected tree situated on private
property. The Mayor and Council shall have the ultimate authority
as to enactment or recommendations and shall not be bound by any recommendations.
The Shade Tree Advisory Board shall keep records of its meetings
and activities and make an annual report to the Mayor and Council.
