An annual fee in an amount as established, from time to time, by resolution of the City Council shall be charged to all licensees. Nonprofit organizations, such as churches and civic organizations, shall be charged a reduced fee in an amount as established, from time to time, by resolution of the City Council; this does not include private clubs which charge a dues fee for memberships. Section 218-4 of this chapter contains a list of nonprofit organizations to be adopted as part of this chapter. Any new establishment requesting nonprofit status must be approved by amendment of this chapter.

A license is required for a temporary food business (not to exceed two consecutive calendar weeks), for which a fee in an amount as established, from time to time, by resolution of the City Council shall be charged. Nonprofit organizations shall be charged a reduced fee in an amount as established, from time to time, by resolution of the City Council. The Health Officer shall determine if a reduced fee is to be charged in accordance with the guidelines established in § 218-1 of this chapter.

All City of DuBois fire stations are hereby exempt from license
fees.
Rules and regulations governing public eating and drinking establishments
shall be the same as those of the Department of Environmental Resources,
known as Subpart D. Environmental Health and Safety, Article I. Food
Protection, Chapter 151, Food Establishments, September 3, 1971, § 151.161.[1]

Any person who shall violate any provision of this chapter shall,
upon conviction thereof, be sentenced to pay a fine of not less than
$50 nor more than $600 plus costs and, in default of payment of said
fine and costs, to imprisonment for a term not to exceed 30 days.
Each day on which a violation of this chapter shall continue shall
be deemed a separate offense.
