The identified floodplain area shall be any areas of the Town of Bloomsburg classified as special flood hazard areas (SFHAs) in the Flood Insurance Study (FIS) and the accompanying Flood Insurance Rate Maps (FIRMs) dated August 19, 2008, and issued by the Federal Emergency Management Agency (FEMA), or the most recent revision thereof, including all digital data developed as part of the flood insurance study and, any community-identified flood hazard areas (including but not limited to "The Flood Recovery Report: Tropical Storm Lee - Wyoming Valley," dated June 2013).

The above-referenced FIS and FIRMs, and any subsequent revisions and amendments, are hereby adopted by the Town of Bloomsburg and declared to be a part of this chapter.

The Bloomsburg identified floodplain area shall consist of the following specific areas:
1. 
FW (Floodway Area). The FW (Floodway Area) shall be the areas identified as "floodway" in the AE Zone by "The Flood Recovery Report: Tropical Storm Lee - Wyoming Valley," dated June 2013, prepared by FEMA. The term shall also include floodway areas which have been identified in other available studies or sources of information for those floodplain areas where no floodway has been identified in the Flood Insurance Study. In this chapter, where not identified and no other data is available, the floodway shall be all land located between the edge of the top-of-bank and 50 feet landward of any watercourse, including Kinney's Run.
2. 
AE Zone. The AE Area/District shall be those areas identified as an AE Zone in the more restrictive of the FIRM included in the FIS or "The Flood Recovery Report: Tropical Storm Lee - Wyoming Valley," dated June 2013, prepared by FEMA for which base flood elevations have been provided. The AE Area adjacent to the floodway shall be those areas identified as an AE Zone on the FIRM included in the FIS prepared by FEMA for which base flood elevations have been provided and a floodway has been delineated.

The A Area/District shall be those areas identified as an A Zone on the FIRM included in the FIS prepared by FEMA and for which no base flood elevations have been provided.

The Bloomsburg identified floodplain area may be revised or modified by Town Council where studies or information provided by a qualified agency or person documents the need for such revision. However, prior to any such change, approval must be obtained from the Federal Emergency Management Agency (FEMA). New technical data with changes must be submitted to FEMA as soon as practicable, but no later than six months after the data, including flood-carrying capacities for any altered, or relocated, watercourse becomes available.

Should a dispute between the floodplain administrator and an aggrieved party concerning any identified floodplain boundary arise, the aggrieved party may appeal to the Zoning Hearing Board. See § 8-212.
