In accordance with the authority granted within N.J.S.A. 40A:11-6,
upon a determination of a snow emergency, any contract may be negotiated
or awarded on behalf of the municipality without public advertising
for bids and bidding therefor, notwithstanding that the contract price
will exceed the bid threshold, when an emergency affecting the public
health, safety or welfare requires the immediate delivery of goods
or the performance of services, in the following manner:
A. The Superintendent of Public Works, upon the occurrence of a snow
emergency, shall notify the Township Administrator of the need for
the performance of a contract for snow plowing, snow removal, sanding,
salting and other needed service, the nature of the emergency, the
time of its occurrence and the need for invoking this section. A "snow
emergency" shall be considered to exist if a legitimate weather forecasting
agency predicts more than six inches of snow and/or another weather-serious
winter emergency, such as an ice storm, which requires additional
equipment and/or manpower, is imminent.
B. If the Township Administrator is satisfied that a snow emergency
exists, the Township Administrator shall direct the Superintendent
of Public Works to authorize the award of a contract or contracts
to address the snow emergency as may be necessary. The Township Administrator
shall file a report as to the award with the Division of Local Finance,
Department of Community Affairs, the Mayor, Committee, and Chief Financial
Officer as soon as practicable.
