A certain document, three copies of which are on file at the Walnutport Borough Municipal Building, located at 417 Lincoln Avenue, Walnutport, Northampton County, Pennsylvania, being marked and designated as the International Fire Code, 2009 edition, and as subsequently amended, including any and all appendix chapters and subsequent appendix chapters as published by the International Code Council, and is hereby adopted as the Fire Code of the Borough of Walnutport, Northampton County, Pennsylvania, regulating and safeguarding of life and property from fire and explosive hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file at the Walnutport Borough Municipal Building are hereby referred to, adopted and made a part hereof, as if fully set forth in length with additions, insertions, deletions and changes, if any, prescribed in § 165-53 of this article.

The following sections of the International Fire Code are hereby revised:
A. 
Section 101.1. Insert: Borough of Walnutport.
B. 
Delete Section 104.10, Fire Investigations.[1]

C. 
Section 109.3. Violation penalties. Persons who shall violate a provisions of this code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work in violation of the approved construction documents or directive of the fire code official, or of a permit or certificate issued under provisions of this code shall be guilty of a violation of this article punishable by a fine for violation of the International Fire Code of not more than $1,000 together with costs of prosecution or by imprisonment for not more than 30 days or both such fine and imprisonment. It is further provided that each day's violation shall constitute a separate offense. The imposition of a penalty for any violation shall not excuse the violation nor shall the violation be permitted to continue. All such persons shall be required to correct or remedy such violations or defects within the time period prescribed by the Borough Fire Chief and/or his designee. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.
D. 
Section 111.4. Insert $1,000 in both locations.
E. 
Delete Section 307, Open Burning.[2]

Nothing in this article or in the Fire Code hereby adopted shall be construed to affect any suit or proceeding pending in any court, in any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this article.
Any amendments which are instituted to the 2009 edition of the International Fire Code shall also automatically be incorporated and adopted to be part of this article.
