The owner of any premises, as to vacant premises or premises occupied by the owner, and the occupant thereof, in case of premises occupied by other than the owner thereof, shall remove, trim or cut all grass, weeds or other vegetation growing or remaining upon such premises in violation of the provisions of §
130-1 of this chapter.
The owner of any premises, as to vacant premises or premises
occupied by the owner, and the occupant thereof, in case of premises
occupied by other than the owner thereof, shall be required to keep
plant life trimmed and cut to a height of no more than 2 1/2
feet when it is within 10 feet of any roadway and within 25 feet of
any intersection of two roadways, except that this section shall not
apply to any leafy tree. A leafy tree shall be defined as any tree
which produces leaves as a part of its normal germinating process
but shall not include bushes or evergreens which normally produce
needles or any other vegetation which produces needles in its normal
germinating process.
The Borough Council, and/or any officer or employee of said
Borough designated thereby for the purpose, is hereby authorized to
give notice, by personal service or by United States mail, to the
owner or occupant, as the case may be, of any premises whereon grass,
weeds or other vegetation is growing or remaining in violation of
the provisions of this chapter. Said notice shall direct and require
such occupant to remove, trim or cut such grass, weeds or other vegetation
so as to conform to requirements of this chapter, within five days
after issuance of such notice. In case any person, firm or corporation
shall neglect, fail or refuse to comply with such notice within the
period of time stated therein, the Borough of Penndel authorities
may remove, trim or cut such grass, weeds or other vegetation, and
the cost thereof, together with any additional penalty authorized
by law, may be collected by the Borough of Penndel from such person,
firm or corporation, in the manner provided by law.

Any person, firm or corporation who shall violate any provision
of this chapter shall, upon conviction thereof, be subject to a fine
of not more than $1,000 or imprisonment for a term not to exceed 30
days, or both, at the discretion of the court. Each day that a violation
continues after due notice has been served, in accordance with the
terms and provisions hereof, shall be deemed a separate offense.
