As used in this article, the following terms shall have the
meanings indicated:
COMMERCIAL USER
Any person, firm or corporation charging a fee for the collection,
transportation and/or dumping of garbage, or those who collect and
dispose of refuse as a secondary aspect of other commercial or business
services, including contractors, construction companies, apartment
owners and agents, and business owners and agents, etc. If a discrepancy
occurs regarding whether an applicant is a commercial collector, such
designation shall be determined by the Director of Public Works or
his representative with the consent of the Mayor.
DISPOSAL AREA
The area designated by the Town of Putnam for the dumping
of garbage.
DUMPING
Includes depositing, discharging, placing and disposing of
garbage.
GARBAGE
Unwanted or discarded materials, including solid, liquid,
semi-solid or contained gaseous materials.
RESIDENT
Those individuals who reside in the Town of Putnam or Pomfret.
Only persons, firms or corporations whose residences or place
of doing business are within the Town limits of Putnam or Pomfret
shall be eligible for a permit to use the facilities of the Town disposal
area for depositing of garbage, rubbish and other refuse originating
in the Towns of Putnam and Pomfret. Municipal and commercial refuse
collection services operating in the Towns of Putnam and Pomfret are
similarly eligible. No person, firm, or corporation, other than those
herein designated, shall, without written permission from the Director
of Public Works and the Selectmen, enter into or upon the disposal
area. The depositing at the disposal area of any garbage, rubbish
or any other refuse not originating in Putnam or Pomfret shall constitute
cause for fines and/or the suspension of the disposal area permit.
Applications for permits shall be obtained from the Department
of Public Works in the Putnam Town Hall, which office shall issue
and revoke all permits authorizing the use of the disposal area, subject
to the provisions of this article and other appertaining regulations.
Appeals for denial or revocation of permits shall be made to the full
Board of Selectmen. All permit stickers shall be affixed and displayed
in the lower right interior corner of the motor vehicle windshield.
The Selectmen are hereby authorized to enact from time to time
other regulations deemed in the public interest regarding the separation,
recovery, collection, removal, storage and disposition of garbage,
rubbish and other refuse, including recyclables and specially designed
materials, in accordance with Connecticut General Statutes P.A. 87-544, and other applicable state regulations.
The Selectmen are authorized to employ and/or negotiate and
entered into contracts with individual persons, corporations, or governmental
agencies for the separation, recovery, collection, removal, storage
or disposition of garbage, rubbish or other refuse, including recyclables.
An annual fee for the use of the disposal area by residents,
contractors, collection services and other eligible parties and for
the deposit of specially designated materials (e.g., tires, machinery)
will be established by the Selectmen. Any other fees deemed necessary
may be instituted by the Board of Selectmen.
A. No person engaged in the business of collection or disposal of garbage
shall deposit garbage in the disposal area without first obtaining
a permit from the Department of Public Works.
B. All permits shall be issued to expire December 31 of each calendar
year. All commercial users shall be charged a tipping fee in accordance
with a schedule set by the Board of Selectmen.
C. The Board is authorized and empowered, prior to issuing a permit,
to require evidence of liability insurance in effect covering all
vehicles to be used to transport garbage into the disposal area.
D. Any commercial user owning more than one vehicle and one removable
body will provide a list of all vehicles and removable bodies to the
Department of Public Works. Changes in vehicles or removable bodies
used to transport garbage to the disposal area shall be provided by
the commercial users as changes occur. The list shall designate each
vehicle by vehicle registration and identification numbers.
E. A licensed commercial user attempting to deposit garbage in the disposal
area which was collected or generated in towns other than Putnam or
Pomfret shall be ordered to remove the vehicle from the disposal area
immediately by the Director of Public Works or his representative,
notwithstanding the fact that part of said load of garbage was collected
or generated in the Town of Putnam or Pomfret.
F. Permits must be in the possession of the operator of a vehicle described
in the permit and shall be shown on request at the time of dumping.
No commercial hauler shall be allowed to dump a load of garbage in
the disposal area if the operator of the vehicle fails to have said
permit in his possession or fails to show said permit on request.
In such instances, such vehicle shall be ordered to be removed from
the disposal area immediately by the Mayor, a member of the Board
of Selectmen, the Director of Public Works or his representative.
A. Except wherever otherwise specified in this ordinance, any person
or permittee violating any provision of this ordinance, or the regulations
enacted hereunder, shall be subject to the following fines and penalties:
(1) First offense: a fine in the amount of $100 plus the suspension of
all rights to use of said landfill area for a period of time not to
exceed one week.
(2) Second offense: a fine in the amount of $100 plus the suspension
of all rights to use of said landfill area for a period of time not
to exceed two weeks.
(3) Third offense: a fine in the amount of $100 plus the suspension of
all rights to use of said landfill area for a period of time not to
exceed two months.
B. In addition, the Town or its agent reserves the right to refuse access
to the disposal area where the provisions of this article or regulations
enacted hereunder are violated.
All garbage, rubbish and other refuse collected and transported
from within the Town of Putnam or Pomfret shall be collected and transported
in such a manner as to prevent scattering of these materials upon
the streets and highways (covered and/or secured). All vehicles used
for the collection or transport of garbage, rubbish or other refuse
within the Town of Putnam or Pomfret shall be subject to inspection
by the Director of Public Works.
It shall be unlawful for any person to throw, deposit, or leave
any litter or rubbish in any public park, public playground or recreation
area, or public street in the Town. Such litter or rubbish shall be
placed in the proper receptacles where these are provided, and when
receptacles are not so provided, such litter or rubbish shall be carried
away by the person responsible for its presence and properly disposed
of elsewhere. Violations of this section shall be punishable by a
fine of not more than $199 for each occurrence.
Except as specifically permitted by the Town, it shall be unlawful
for any person to throw upon the street, or any other property under
the control of the Town, or in any catch basin, fire hole, drain,
river, or other waterway in the Town, any garbage, rubbish or other
refuse.
No person having custody or control of residential, industrial
or business premises from which garbage, rubbish or other refuse,
including recyclables, is collected for disposal in the disposal area
shall permit or cause any garbage, rubbish, or other refuse, including
recyclables, within his/her control to become a hazard to public travel,
health or safety or to become a nuisance of any sort.
It shall be unlawful to dispose of, within the Town of Putnam,
materials which are identified by the Resource Conservation and Recovery
Act (RCRA) as hazardous materials.
The law enforcement agency of the Town of Putnam shall be charged
with enforcement of the provisions of this article, together with
Town Constables, and any legal recourse, civil or criminal, available
to the Selectmen.
