There is hereby created and established a sewer and water utility
within the Township of Upper Deerfield, which shall function as a
separate entity within the Township of Upper Deerfield, authorized
for accounting purposes to charge and receive rents and fees for sewer
service and water service; to maintain separate accounts; to incur
and pay for necessary expenses; to hold, use and operate property
and equipment; to borrow money; to adopt and maintain a separate budget
for these purposes; and to perform any or all of these functions from
time to time when authorized or approved by the Township Committee.
The aforesaid entity shall be known as the "Township of Upper
Deerfield Sewer and Water Utility."
The Township Committee may from time to time adopt by resolution
reasonable rules and regulations for the operation of said Utility.
It shall be the function of said utility to be responsible for
the operation, functioning and maintenance of all sewer facilities
and water facilities owned by the Township of Upper Deerfield, including
all equipment, tanks, pumping stations, collector lines, interceptor
lines, force mains and all treatment and distribution facilities.
The financial affairs of said facility shall be governed by
the Township Committee. Said utility may from time to time acquire
property and borrow money when authorized by the Township Committee
according to law.
All employees required to provide sewer and water service by
said utility shall be appointed and employed by the Township Committee.
A separate budget for said utility shall be annually prepared
and adopted by the Township Committee, separate and apart from the
municipal budget, which separate budget may be amended from time to
time, and all salaries and expenses incurred and paid by or on behalf
of said utility shall be charged against the appropriations created
in said utility budget, and all fees and charges collected from users
of sewer service or water service shall be credited against said budget.
Said utility is hereby authorized to collect and receive all
fees and other charges due from property owners for the use of the
sewer facilities or water facilities, which funds shall be used to
pay the cost of construction, operation and maintenance of sewer and
water facilities.
Except as modified by the provisions hereof, Chapter
328, concerning sewer use, and Chapter
396, concerning water supply systems, of the Code of the Township of Upper Deerfield shall remain in full force and effect, and all operations and functions of the Township of Upper Deerfield Sewer and Water Utility shall be governed by the terms and conditions thereof.
