Township of Upper Deerfield, NJ Chapter 384 Vehicles, Unauthorized Use of Municipal

§ 384-1 Unauthorized use outside Township limits.

The unauthorized use or the use by unauthorized personnel of fire apparatus, fire-fighting equipment and vehicles; emergency apparatus, equipment and vehicles; and highway apparatus, equipment and vehicles owned by the Township of Upper Deerfield is strictly prohibited.

§ 384-2 Emergency situations.

A. The Upper Deerfield Township volunteer fire companies, by their proper officers and members, may, from time to time, in case of emergency, take Township-owned fire apparatus and fire-fighting equipment and vehicles and emergency apparatus, equipment and vehicles into a neighboring municipality to render aid in the event of an emergency when such aid shall have been requested by the officials of such neighboring municipality or by the officers of the fire department thereof or to any municipality with which the Township of Upper Deerfield has entered into a mutual-aid agreement for the purpose of providing assistance in the event of an emergency.

B. The Township maintenance offices or departments, by their proper supervisors and workers, may, from time to time, in case of emergency, take Township-owned road and/or maintenance apparatus, equipment and vehicles into any neighboring municipality to render aid in the event of an emergency when such aid shall have been requested by officials of such neighboring municipality.

§ 384-3 Nonapplicability.

Nothing herein contained shall be construed to prohibit the taking of fire apparatus and fire-fighting equipment and vehicles; emergency apparatus, equipment and vehicles; and road and/or maintenance apparatus, equipment and vehicles of said Township of Upper Deerfield outside the limits thereof by persons having lawful custody of such apparatus and equipment and vehicles for the purpose of having the same repaired or serviced.

§ 384-4 Violations and penalties.

Any person who shall violate any of the terms or provisions of this chapter or do any act or thing therein prohibited shall, upon conviction thereof, pay a fine not exceeding the sum of $100 or be imprisoned in the county jail for such term, not exceeding 30 days, as shall be determined and imposed by the Municipal Judge before whom such person shall be tried and convicted; provided, however, that such Municipal Judge shall have the power, in his discretion, to impose both fine and imprisonment not exceeding the respective maximum limits herein fixed. Where personnel of the Township of Upper Deerfield are held responsible, they shall also be subject to appropriate disciplinary action.
