The Board of Supervisors of Newtown Township, constituting the "Municipal Authority" of the Township as defined in the Municipality Authorities Act of 1945[1] (the Act of May 2, 1945, P.L. 382, as amended and supplemented), hereby signifies its intention to organize an Authority under the provisions of the Municipality Authorities Act of 1945.

The name of the proposed Authority shall be "Newtown Township, Delaware County, Sewer Authority." In pursuance of such intention, the Articles of Incorporation of the Authority are hereby approved and adopted by the Board of Supervisors in the form attached to Ordinance No. 1961-3.
ARTICLES OF INCORPORATION
NEWTOWN TOWNSHIP, DELAWARE COUNTY, SEWER AUTHORITY
TO THE SECRETARY OF THE COMMONWEALTH OF PENNSYLVANIA:
In compliance with the "Municipality Authorities Act of 1945"[1] (the Act of May 2, 1945, P.L. 382, as amended and supplemented), the Township of Newtown, Delaware County, Pennsylvania, pursuant to an ordinance duly enacted by its Board of Supervisors authorizing and directing the formation of an Authority under said Act, DOES HEREBY CERTIFY:
(a)
The name of the Authority shall be "Newtown Township, Delaware County, Municipal Authority."

(b)
The said Authority is formed under the "Municipality Authorities Act of 1945" (the Act of May 2, 1945, P.L. 382, as amended and supplemented), and said Authority shall be for the purpose of acquiring, holding, constructing, improving, maintaining and operating, owning, leasing, either in the capacity of lessor or lessee, for the Township of Newtown (the "Township"): (i) land, buildings and structures for the conduct of Township meetings, the administration of municipal government, the operation of the police and other departments of the Township government, and the housing, operation and repair of municipal vehicles, equipment and other property, parks and recreation facilities, or any other use as authorized by the Township; (ii) equipment to be leased to the Township; and (iii) sewers, sewer systems or parts thereof, sewage treatment works, including works for treating and disposing of industrial waste, for the Township and for such other territory as it may be authorized to serve.

(c)
No other Authority has been organized under the Municipality Authorities Act of 1945 or under the Act approved June 28, 1935, P.L. 463, or is in existence in or for the said Township of Newtown.

The name of the incorporating municipality is the Township of Newtown, Delaware County, Pennsylvania; and the names and addresses of its municipal authorities are as follows:

REED and DANIEL W. LLEWELLYN, whose official position in the Township of Newtown, Delaware County, Pennsylvania, are respectively Chairman and members of the Board of Supervisors of said Township and the Secretary of said Township, and who, in due form of law, acknowledged the foregoing Articles of Incorporation to be the act and deed of the Township of Newtown for the purposes therein specified.
