Pursuant to the Act of Assembly of the Commonwealth of Pennsylvania
as set forth in Act No. 247, approved July 31, 1968, known as the
"Pennsylvania Municipalities Planning Code," there is hereby created and established a Planning Commission
for Newtown Township, to be known as and hereinafter referred to as
the "Newtown Township Planning Commission."
The Newtown Township Planning Commission shall consist of seven
members, to be appointed as hereinafter provided, all of whom shall
be Township residents.
All members of the Newtown Township Planning Commission shall
be appointed by the Board of Supervisors.
Except as hereinafter provided, all members of the Newtown Township
Planning Commission shall serve for terms of four years or until their
successors are appointed and qualified. However, the initial and subsequent
terms of members shall be so fixed such that no more than two members
shall be reappointed or replaced during any calendar year.
If a vacancy occurs in the Newtown Township Planning Commission
other than by expiration of term, the Board of Supervisors shall fill
such vacancy for the unexpired term. The Chairman of the Newtown Township
Planning Commission shall promptly notify the Board of Supervisors
concerning any vacancy in the Newtown Township Planning Commission.
Any member of the Newtown Township Planning Commission may be
removed from office for malfeasance, misfeasance or nonfeasance in
office or for other just cause by a majority vote of the Board of
Supervisors taken after the member has received 15 days' advance written
notice of the intent to take such a vote. A hearing shall be held
in connection with the vote if the member shall request it in writing.
The Township Engineer or an engineer appointed by the Board
of Supervisors shall serve the Newtown Township Planning Commission
as engineering advisor.
All members of the Newtown Township Planning Commission shall
serve without pay, but may be reimbursed for necessary and reasonable
expenses at the discretion of the Board of Supervisors.

The Newtown Township Planning Commission shall elect its own
Chairman and Vice Chairman and create and fill such other offices
as it may determine and establish. Officers shall serve annual terms
and may succeed themselves. The Newtown Township Planning Commission
may make and alter bylaws and rules and regulations to govern its
procedures, consistent with Township ordinances and the laws of the
Commonwealth of Pennsylvania. The Newtown Township Planning Commission
shall keep a full record of its business.
The Newtown Township Planning Commission shall have all of the
powers and authority conferred upon and all of the duties and obligations
imposed upon planning commissions of Second Class Townships under
and pursuant to the Pennsylvania Municipalities Planning Code, Act
No. 247, approved July 31, 1968, as well as all amendments, supplements, modifications,
revisions and deletions thereto and therefrom which may hereafter
be enacted.
