the 1992 Code)]
For the purpose of this article, the following terms shall have
the meanings indicated:
BONA FIDE RESIDENT
A person having permanent domicile within the Borough of
Wallington and one which has not been adopted with the intention of
taking up or claiming a previous residence acquired outside of the
Borough's boundaries.
Subject to the provisions of this article, all officers and
employees employed by the Borough shall be bona fide residents therein.
Any nonresidents hereinafter appointed to positions of employment
within the Borough shall be required to become residents of the Borough
within one year of their appointment, except as hereinafter set forth.
Failure of any employee to maintain residency within the Borough
of Wallington shall be grounds for removal or discharge from services.
Any employee found to be not maintaining a bona fide residency within
the Borough shall be notified to again take up bona fide residency
in the Borough, and if the same is not accomplished within six months
of such notification, the result will be removal or discharge from
service. Such removal or discharge shall take effect on the date specified
within the notice, subject to appeals pursuant to law.
In promoting employees, residents shall be given preference
over nonresidents. The preference granted herein, however, shall in
no way reduce or affect the preference granted pursuant to any other
provision of the law.
