The citizens of the State of New York from time to time inhabitants
of the territory in the County of Westchester, included in the boundaries
set forth in C1-2 hereof, and known as the City of Yonkers, are continued
a municipal corporation in perpetuity under the name of "The City
of Yonkers."
The said city shall be bounded westerly by the westerly line
of the County of Westchester, northerly by the Town of Greenburgh,
easterly by the middle line of the Bronx River as the same existed
at the time of the original incorporation of the City of Yonkers,
and southerly by the City of New York, except, that that portion of
the easterly boundary lying between the City of Yonkers and the Village
of Bronxville shall be the middle line of said river as the same existed
on April 13, 1954.

Reapportionment of ward boundaries shall be made every ten (10)
years on the basis of the decennial census figures published by the
Bureau of Census, U.S. Department of Commerce, so as to provide for
twelve (12) wards of substantially equal population.
At any time before the 31st day of December, 1971, and every
ten (10) years thereafter but in no event later than forty-five (45)
days after the final decennial census figures, as enumerated by tract,
block and district, are published by the Bureau of Census, the Mayor
shall appoint a commission with the advice and consent of the City
Council to prepare new ward boundaries so as to provide for twelve
(12) wards of substantially equal population.
The Commission shall consist of five (5) members, two (2) of
whom shall be members of the City Council, and not more than one (1)
of whom shall be of the same political party, and three (3) citizens
of the city, not more than two (2) of whom shall be of the same political
party. The Mayor shall designate the Chairman of the Commission.
Within one hundred twenty (120) days after its appointment,
the Commission shall report to the City Council by filing with the
City Clerk its plan for new ward boundaries. In the event that the
Commission shall fail to report to the City Council by not filing
its plan with the City Clerk within such one hundred twenty (120)
day period, any registered voter of the city shall be deemed a person
aggrieved for the purpose of bringing a proceeding in the New York
State Supreme Court to compel the filing of a plan.
Upon the filing of such a plan with the City Clerk, the Corporation
Counsel shall prepare a local law, embracing the delineation of the
new ward boundaries as proposed by such plan, for consideration by
the City Council. Any such local law changing the boundaries of wards
from which members of the County Board of Legislators, chosen as such
in the city to represent the city, are elected, shall be subject to
a mandatory referendum as provided by law.
In the event that the City Council either does not adopt the
plan within sixty (60) days after it has been filed or does not adopt
another plan within such sixty-day period, the City Clerk shall certify
to the Board of Elections the question: "Should the plan proposed
by the Commission for new ward boundaries be adopted?" and the question
shall appear as a referendum proposition to be voted upon by the voters
in the next general election, to become effective, if adopted, January
1, next suc-ceeding.
Members of the Commission shall not receive any compensation
for their services, but shall be reimbursed for the actual and necessary
expenses incurred by them in the performance of their duties.
