It has become the common practice of certain persons to affix
posters, signs and other literature to trees, poles, trestles, traffic
signs and other structures in the Borough and to write names and slogans
on the streets and sidewalks of the Borough. These persons thus obliterate,
obstruct and deface trees, poles, trestles, traffic signs and other
structures and confuse, obstruct and deface lawful markings upon the
streets and sidewalks of the Borough, all to the great danger of the
safety and welfare of the residents of the Borough and others using
the streets and sidewalks of the Borough.
A.
Posting of signs. It shall be unlawful for any person to post or attach or permit to be posted or attached in any way or manner any literature, posters, pictures or other writings to any tree, pole, post, trestle, traffic sign, traffic signal, wall, fence, building or other structure in the Borough. Legal signs specifically permitted and for which a permit has been obtained pursuant to Chapter 365, Zoning, are not hereby affected. Nothing herein shall be construed to prohibit the posting or attaching of literature, posters, pictures or other writings on private property with the express consent of the owner.

B.
Painting on streets and sidewalks.[1] It shall be unlawful for any person to draw, write or
print or to permit to be drawn, written or printed on the streets
or sidewalks in the Borough any slogan, motto, name or symbol, whether
written with chalk, paint or any other substance. Nothing herein shall
be construed to prevent properly authorized persons from making the
legal and necessary traffic control marks, lines, words or symbols
on the streets and sidewalks of the Borough.

A.
The governing body hereby finds that certain buildings or properties
owned by the Borough of Wallington are not used for public purposes
during certain periods of time and further finds that some of these
buildings or properties contain separate facilities and/or meeting
halls the proper use of which will not in any way interfere with,
interrupt or affect the primary function for which the buildings were
constructed or the properties are maintained.
B.
It is a further finding of the governing body that civic-oriented
and nonprofit organizations within the Borough of Wallington have
used these buildings or properties for meetings and for functions
for many years and that such meetings and functions are beneficial
to the overall good of the Borough of Wallington.
Any civic-oriented or nonprofit organization in the Borough
of Wallington shall be permitted to use the buildings or properties
owned by the Borough of Wallington, subject to permission from the
Mayor and Council.
Any group seeking the use of a public building or property shall:
A.
Submit a letter of application stating the time and purpose of the
use and specifying which building or portion of which building or
property is requested.
B.
Submit to the governing body the names and addresses of those officers
or persons in charge of said organization who shall be individually
responsible for the care, use and possible damage to said buildings,
equipment and/or furniture or property.
Said application shall be granted only if the holding of said
meeting and/or function shall not interfere with the primary function
for which said buildings are constructed or properties are maintained
and their use for public purposes. The group shall have exclusive
use of only that portion of the building or property for which it
was granted approval.
The governing body may by resolution make additional rules and
regulations regarding the use of said public buildings or properties,
including prescribing security deposits for use of said buildings
or properties. All users of the building or property shall comply
with all Borough ordinances and federal and state regulations.
