As used in this chapter, the following terms shall have the
following meanings, unless the context clearly indicates a different
meaning. For words utilized in this chapter, but not defined herein,
the definitions utilized in other chapters of this Code shall apply.
APPLICANT
A developer submitting an application for site plan review.
APPLICATION FOR DEVELOPMENT
The application form and all accompanying documents required
by ordinance for approval of a subdivision plat, site plan, planned
development, conditional use, zoning variance, or permit to build
in a mapped area or for a structure not related to a street.
APPROVAL
A.
Preliminary site plan approval indicates that the preliminary
site plan as submitted meets all requirements of applicable municipal
ordinances and confers upon the applicant all of the benefits provided
for in N.J.S.A. 40:55D-49.
B.
Final site plan approval shall mean the official action taken
on a preliminary approved site plan after all conditions, engineering
plans and other requirements have been completed or fulfilled and
required improvements have been installed or guarantees properly posted
for their completion or approval conditioned upon the posting of such
guarantees.
DEVELOPER
The legal or beneficial owner or owners of a lot or of any
land proposed to be included in a proposed development including the
holder of an option or contract to purchase, or other person having
an enforceable proprietary interest in such land.
FOOTCANDLE (fc)
A unit of illuminance on a surface one foot square in area
onto which there is a uniform flux of one lumen.
FOOTLAMBERT (fl)
A unit of luminance of a surface reflecting or emitting light
at the rate of one lumen per square foot. The average luminance of
any reflecting surface in footlamberts is the product of the illuminance
in footcandles striking the surface times the reflectance of the surface.
GLARE
The sensation produced by luminance within the visual field
that is efficiently greater than the luminance to which the eyes are
adapted to cause annoyance, discomfort or loss in visual performance
and visibility.
IESNA
Illuminating Engineering Society of North America. An organization
that recommends standards for the lighting industry. The IESNA is
the recognized technical authority on illumination. www.iesna.org.
ILLUMINANCE
The area density of the luminous flux incident at a point
on a surface, expressed in footcandles (fc). A measurement of light
on the illuminated surface. Measured by a light meter placed on the
illuminated surface.
ILLUMINANCE, VERTICAL
The illuminance on a vertical plane, expressed in footcandles
(fc). Typically used to measure glare and light trespass levels. To
measure vertical illuminance, the meter is held vertically, at eye
level (five feet), sensor towards light source, and a reading noted
in footcandles.
LIGHT TRESPASS
Any form of artificial illuminance emanating from a light
fixture or illuminated sign that penetrates other property and creates
a nuisance.
LUMEN
Measurement of light output. One lumen is equal to the amount
of light emitted by one candle that falls on one square foot of surface
located one foot away from the candle.
LUMINANCE
The quantity of light ("brightness") reflected or emitted
towards an observer, expressed in lumens per square foot. Used primarily
to measure internally illuminated signs. Most other applications use
illuminance (footcandles).
MAINTENANCE GUARANTEE
Any security, other than cash, which may be accepted by the
Township for the maintenance of any improvement required by this chapter.
MINOR SITE PLAN
The development plan of one or more lots which does not involve
planned development, any new street or extension of any off-tract
improvement and contains the information reasonably required in order
to make an informed determination as to whether the requirements established
by this chapter for approval of a minor site plan have been met and
shall be limited to the following classes of development:
A.
A change in use involving no building construction, other than
interior modifications or interior structural alterations, and no
need for additional off-street parking, lighting or drainage improvements.
B.
Minor structural changes, such as entry enclosures, porticos,
and other structural appurtenances, including roof appurtenances.
C.
Building additions not exceeding 100 square feet in ground coverage
and accessory buildings and structures not exceeding 500 square feet
in ground coverage, provided that the same do not invade upon any
required parking area, setback area or otherwise violate any requirements
of the Township development regulations.
D.
Site plans detailing development not reasonably anticipated to create impacts beyond those normally attending applications otherwise meeting the requirements of Subsections
A,
B, and
C above.
MOTION SENSOR DEVICE
A device that will sense motion electronically and switch
on security lighting for a brief duration.
OBJECTIONABLE DIRECT GLARE SOURCE
Glare resulting from excessive levels of illumination or
insufficiently shielded light sources, emanating from light fixtures
in the field of view where the lens, lamp or reflector is offensively
visible above a height of five feet at a property line or a public
roadway.
OFF-SITE
Located outside the lot lines of the lot in question but
within the property of which the lot is a part which is the subject
of a development application or the closest half of the street or
right-of-way abutting the property of which the lot is a part.
OFF-TRACT
Not located on the property which is the subject of a development
application nor on contiguous portions of a street or right-of-way.
ON-SITE
Located on the lot in question and excluding any abutting
street or right-of-way.
ON-TRACT
Located on the property which is the subject of a development
application or on a contiguous portion of a street or right-of-way.
OUTDOOR LIGHT FIXTURE
An electrically powered illuminating device, in place outdoors
for 30 days or more, containing a total light source of more than
1,000 initial lumens per fixture (this is greater than a single 60
watt incandescent), including but not limited to devices used to illuminate
any site, architectural structure or sign.
PERFORMANCE GUARANTEE
Any security which may be accepted by Fredon Township, including
but not limited to performance bonds, escrow agreements, and other
similar collateral or surety agreements.
PRELIMINARY FLOOR PLANS AND ELEVATIONS
Architectural drawings prepared during early and introductory
stages of the design of a project illustrating in a schematic form
its scope, scale, and relationship to its site and immediate environs.
SHIELDED LIGHT FIXTURE
A light fixture with cutoff optics that allows no direct
light emissions above a vertical cutoff angle of 90° above nadir
(straight down at perfect vertical), through the light fixture's
lowest light-emitting part. Any structural part of the light fixture
providing this cutoff angle must be permanently affixed.
SITE PLAN
A development plan of one or more lots on which is shown:
A.
The existing and proposed conditions of the lot, including but
not necessarily limited to topography, vegetation, drainage, floodplains,
marshes and waterways;
B.
The location of all existing and proposed buildings, drives,
parking spaces, walkways, means of ingress and egress, drainage facilities,
utility services, landscaping, structures and signs, lighting, and
screening devices as required by site plan detail sections of this
chapter; and
C.
Any other information that may be reasonably required in order
to make an informed determination, pursuant to an ordinance requiring
review and approval of site plans by the Land Use Board.
SKYGLOW
Luminance in the atmosphere caused by dust, water vapor,
and other particles that reflect and scatter any stray lighting that
is reflected or emitted into the atmosphere.
UNIFORMITY RATIO
The ratio of the brightest spot to the dimmest spot, or the
ratio of the average brightness to the minimum brightness.
