Pursuant to N.J.S.A. 43:15C-2, the following positions are deemed to be eligible for and shall participate in the DCRP so long as the position does not fall within the ineligibility restrictions set forth in N.J.S.A. 43:15C-2(b):

Elected officials.
B. 
Municipal Court Judge.
C. 
Municipal Prosecutor.
D. 
Public Defender.
Pursuant to N.J.S.A. 43:15C-2, individuals serving in the following positions are exempt from the DCRP membership:
A. 
Tax Collector.
B. 
Chief Financial Officer.
C. 
Construction Code Official.
D. 
Tax Assessor.
E. 
Registered Municipal Clerk.
F. 
Licensed Uniform Subcode Inspector.
G. 
Principal Public Works Manager.

A. 
Payment of sick leave upon retirement.
(1) 
Pursuant to N.J.S.A. 40A:9-10.4 (L.2010, c.3, § 2), employees or officers commencing service on or after May 21, 2010, upon retirement, shall be eligible for payment for the number of unused sick days accrued or $15,000, whichever is less.
(2) 
Pursuant to N.J.S.A. 40A:9-10.2 (L.2007, c.92, § 43), employees or officers commencing employment on or before June 8, 2007, upon retirement, shall be eligible for payment for the number of unused sick days in an amount not to exceed the amount so accumulated as of June 8, 2007, or $15,000, whichever is greater.
(3) 
Pursuant to N.J.S.A. 40A:9-10.2 (L.2007, c.92, § 43), employees or officers commencing employment after June 8, 2007, upon retirement, shall be eligible for payment for the number of unused sick days in an amount not to exceed the amount so previously accumulated or $15,000, whichever is greater.
(4) 
Supplemental compensation shall be payable only at the time of retirement from a state-administered or locally administered retirement system based on the leave credited on the date of retirement.
(5) 
The provisions in this section governing payment for accumulated, unused sick leave upon retirement shall be implemented and applied in accordance with N.J.S.A. 40A:9-10.2 and N.J.S.A. 40A:9-10.4, as amended from time to time, any judicial rulings construing those provisions, and any regulations or guidelines issued by the Local Finance Board or Division of Pensions and Benefits.
A copy of this article shall be filed with the Director of the Division of Pensions and Benefits of the New Jersey Department of the Treasury.
