No rifle or pistol range shall be established contrary to the provisions of Chapter 395, Zoning.
The Board of Supervisors shall appoint a committee of three qualified individuals to review and make recommendations om all requests for the establishment of a rifle or pistol range. Said committee shall be known as the "Range Committee" and shall consist of the following:
A. 
One representative from the Board of Supervisors of Fairview Township.
B. 
One representative from the Planning Commission of Fairview Township.
C. 
One representative from the Erie County Council of Sportsmen's Clubs, who is also a resident of Fairview Township.
All approvals for the establishment of a rifle or pistol range shall be subject to revocation by the Board of Supervisors if it is found after investigation by the Range Committee that the range is being improperly operated, used or maintained.
Nothing contained in this article shall be interpreted so as to contradict the game laws of the Commonwealth of Pennsylvania.
A. 
Any person who shall operate, use or maintain a pistol range contrary to the provisions of this article shall be required to pay a criminal fine of not less than $25 nor more than $300, together with costs of prosecution, for each such violation, and may upon default of payment of said fine be sentenced to imprisonment to the extent allowed by law for the punishment of summary offenses. A separate offense shall arise for each day or portion thereof in which a violation of this article is found to exist. The enforcement of this article shall be by action brought before a Magisterial District Judge in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure.
B. 
In addition to the remedy set forth in Subsection A above, this article may be enforced through an action in equity in the Court of Common Pleas of Erie County, Pennsylvania.
All fines levied, assessed and paid under the terms of this article shall be payable by the Magisterial District Judge to the Treasurer of the Township for the general use of the Township.
