This chapter shall be cited and may be referred to hereafter as the "Building Numbering Law of the Town of Poestenkill."
In order to facilitate the rapid location of buildings along the various roads and highways by fire, police and other emergency services and to facilitate the reporting of emergencies and dispatching of emergency vehicles and personnel under the Rensselaer County 911 system, the Town Board does hereby deem the numbering of all buildings and the display of such numbers in a manner to enable rapid identification of buildings to be of major importance to the Town of Poestenkill. In order to effectuate the efficient and accurate numbering of buildings, the Town Board hereby enacts this chapter.
As used in this chapter, the following terms shall have the meanings indicated:
BUILDING
The principal building or each of the principal buildings on each lot, which shall not be deemed to include any accessory building.
FRONT
That side of the building which faces the street used with the building's number in the building's designated street address.
All existing buildings in the Town of Poestenkill and any buildings hereafter constructed shall have displayed upon the front of each said building a number uniquely identifying said building's location on that road, street or highway. Buildings set back from the road shall comply with the requirements of § 96-6D of this chapter.

Building numbers shall be assigned by the Town in conformance with the Rensselaer County Emergency Management (911) System of numbering. Numbers for new buildings will be assigned at the time of issuance of a building permit. The building number and street name will be recorded on both the building permit and the certificate of occupancy for that building. Records of building numbers for both existing and new buildings will be maintained in the office of the Town Assessor.
A. 
The numbers to be displayed on a building shall conform to the requirements of the New York State Uniform Fire Prevention and Building Code.[1]

B. 
The numbers shall not be obstructed by trees, shrubbery, porches or other extensions of the building.
C. 
Wherever practicable, said number shall be placed near some light or source of illumination so that it may be readily seen at night.
D. 
If the building upon which the number is to be displayed is more than 75 feet from the edge of the road, street or highway serving the building, the number shall, in addition to the other requirements contained herein and in addition to being displayed on the front of the building itself, be displayed on a sign readily visible from the road, street or highway serving the building and in no event further back than 25 feet from said road, street or highway right-of-way.
The display of any house number within the Town of Poestenkill other than the number assigned by the Town pursuant to this chapter is expressly prohibited.
All existing buildings in the Town shall display the assigned number in the manner required by § 96-6 hereof within 60 days of the effective date of this chapter. Any buildings for which a certificate of occupancy is issued after the effective date of this chapter will be required to be in compliance with this chapter's provisions upon issuance of the certificate of occupancy.
The owner of the property on which the building is located is responsible for the posting of numbers in the manner required by this chapter. The owner is also responsible for the continuing maintenance and legibility of the required numbers.
The Code Enforcement Officer of the Town of Poestenkill shall be responsible for the enforcement of this chapter.
A. 
Any property owner found not to be in compliance with any provision herein shall be given a ten-day notice to remedy said violation.
B. 
Any property owner who fails to comply with said notice shall be liable for a civil penalty in the sum of up to $25 per address for each week or portion thereof that the violation shall continue to exist following the issuance of the aforesaid notice to remedy and the expiration of the aforesaid ten-day cure period. The penalty hereby established and authorized is declared to be civil in nature.
C. 
Service of notice. The notice provided for in Subsection A above may be given by personal delivery to the owner or by mailing a copy thereof to the last known address of the owner by certified mail, return receipt requested.
Upon the application of the owner of the property, the Town Supervisor or his/her designee may, after consultation with the office of Rensselaer County Emergency Management, vary or modify the requirements contained herein with respect to that property upon such terms and conditions as he/she deems appropriate. There shall be no appeal from the decision of the Town Supervisor on an application made under this section.
