This article is enacted for the purposes of promoting and protecting the public health and safety in accordance with § 30.77(3)(a), Wis. Stats. The intent is to provide safe and healthful conditions for the enjoyment of aquatic recreation consistent with public rights and interest and the capability of the water resource.
The provisions of this article shall apply to the waters of the Wisconsin River in the Village of Rothschild located between the base of the Rothschild Dam and its spillway and a line 700 feet downstream from the base of said dam and spillway and may be enforced by the officers of the Village and by officers of the Wisconsin Department of Resources and the Marathon County Sheriff's Department.
The area of the Wisconsin River downstream from the base of the dam and spillway of the Rothschild Dam within 700 feet of the dam and spillway is declared a restricted area at any and all times when dam strobe lights are in operation or when any of the steel or wooden spillway gates are open, and the use or operation of any boat by any person is prohibited in that restricted area during such times.
The penalty provisions of § 30.80, Wis. Stats., and any subsequent amendments thereto, are incorporated herein in their entirety by specific reference as if set forth in full. It is the intent of this penalty provision to be in conformity with state statutes.
The regulation of this article shall be prominently posted at public access points to the restricted area and filed with the Department of Natural Resources. The restricted area may be marked with buoys in conformity with Wisconsin Statutes.
