The Borough hereby adopts in its entirety, with the exception
of the section herein set forth, the standards, rules and regulations
promulgated in the National Fire Protection Association Code, entitled
"The National Fire Code," encompassing 10 volumes, and the revisions
and amendments thereto. A complete set of copies shall be on file
at the Borough Hall at all times hereafter.
It is the intent, purpose and scope of this section to provide
for the designation of fire lanes whenever it appears that parking
congestion may create a hazard by impeding the free movement of fire-fighting
equipment anywhere within the Borough on public or private property.
A. Definitions. As used in this section, the following words shall have
the meanings set forth below:
FIRE MARSHAL
The Fire Marshal of the Borough of West View, or such other
person appointed by said Fire Marshal for the enforcement and administration
of this section. The Fire Marshal shall be appointed by the Fire Chief
of the Borough of West View for a term of one year.
B. Designation of fire lanes. The Fire Marshal shall have the power
to designate fire lanes anywhere within the Borough, on public or
private property, where said Fire Marshal deems that parking congestion
may create a hazard by impeding the free movement of fire-fighting
equipment. The Fire Marshal shall consult the Council of the Borough
of West View and the Borough Planning Commission prior to making such
a designation, and must obtain the approval of the Council of the
Borough of West View before making such a designation. Such fire lanes
shall be marked in such a fashion as to indicate their location and
shall be posted with no-parking signs. Parking shall be prohibited
within the designated fire lanes.
C. Enforcement. The Fire Marshal shall prescribe and issue all forms
necessary for the administration of this section and may adopt and
enforce regulations relating to any matter pertaining to the administration
of this section, including, but not limited to, the imposition and
collection of fines for violations. The Fire Marshal may designate
a Fire Inspector, the Borough Police, a private property owner security
force or other persons to enforce this section, either singularly
or in conjunction with each other.
D. Special penalties for violations of this section. Any car owner who
parks or permits his car to be parked within a designated fire lane
zone will be prosecuted by the Fire Marshal. A fine of $5 shall be
imposed for each violation and shall be collected by the Fire Marshal
by a ticketing procedure whereby the fine may be paid at the Borough
Municipal Building. If the fine is not paid within 10 days, the Fire
Marshal shall further prosecute the violator before the Magisterial
District Judge. If such further prosecution is necessary, the violator
shall pay a fine of $15 plus costs imposed by the Magisterial District
Judge. In default of payment of fine and costs, the violator may be
sentenced to imprisonment in the Allegheny County Jail for not more
than 30 days. If payment is made at the Borough Municipal Building
within 24 hours, the fine shall be $2.
The fire protection for any new structures with exterior wall
conditions, one or more stories in height, not including basements,
subbasements, garages, penthouses, lofts or attics, measuring 10,000
square feet or more in floor area per floor, shall include the required
installation of monitored fire and smoke ventilation devices as set
forth in more particularity in this chapter.
The purpose of this section is to provide for the proper removal
of abandoned flammable liquid pumps or flammable liquid storage tanks.
A. Definitions. As used in this section, the following terms shall have
the meanings indicated:
ABANDONMENT
Failure to conduct business or use flammable liquid distribution
pumps or storage tanks for a period of 30 days or more.
B. No individual, corporation, unincorporated association, nonprofit
corporation, joint-venture, partnership or sole proprietorship shall
abandon or otherwise leave unattended or unmaintained for more than
30 days any flammable liquid distribution pump or storage tank.
C. If said flammable liquid distribution pump or storage tank is so
abandoned, the parties so abandoning said apparatus must remove same
upon notice by the Fire Marshal.
D. Extension of time for removal.
(1) Upon written notice to the Fire Marshal, the parties may request
an extension of time for removal if:
(a)
It appears that the parties intend to cease said abandonment
and reopen said business, or to return said equipment to functional
use.
(b)
Presentation of modified evidence indicates that said removal
cannot be obtained for a stated period of time, which shall not be
in excess of 90 days.
(2) Said request for extension of time and the testimony thereon shall
be considered by the fire prevention officers, who shall be the Fire
Chief, the Fire Marshal and the Borough Solicitor. A majority vote
of said officers shall control any decision regarding an extension
of time.

Fees shall be paid by any applicant for permits as called for
under the Fire Prevention Code of the Borough of West View. The fees
and permits necessary are for new installations and remodeling of
existing installations and shall be paid to the office of the Building
Inspector.
Gasoline service stations using automatic dispensing units shall
be attended by the owner's representative or agent while Class
I liquids are being dispensed into any container, tank or vehicle.
This attendant shall not be further than five feet from the dispensing
nozzle at any time during the dispensing of Class I liquids.
All existing chimneys, smokestacks or similar devices for conveying
smoke or hot gases to the outer air and all stoves, ovens, furnaces,
incinerators, boilers or any other heat-producing devices or appliances
shall be constructed in accordance with the Building Code and maintained
in such a manner so as not to create a fire hazard. For all residential
dwellings, a permit must be applied for the installation of said devices;
however, there shall be no charge to the resident of a residential
area as defined by the Code of the Borough of West View for said inspection
or for said permit.
