The existence, maintenance or planting of Carolina poplar trees in or near the highways of said Borough is hereby declared to be a nuisance, and it shall be the duty of the Highway Committee of the Borough to remove said trees.
Whenever any tree or trees of any kind in or near the highways or elsewhere within the limits of said Borough shall become an obstruction or damage to any sewer or sewers of said Borough, it shall be the duty of the Highway Committee of said Borough to remove said tree or trees as it may be deemed necessary to remove said obstruction or damage to said sewers, provided that in all cases, before the Highway Committee shall take action as hereinbefore provided, it shall notify the owners or occupiers of the land in front of or upon which said tree or trees stand to remove the same within 10 days, and if the owners or occupiers shall neglect or refuse so to do after notice as aforesaid, then it shall be the duty of said Highway Committee to cause said tree or trees to be removed and collect the costs thereof by lien or suit from the owners or occupiers.
