The several volunteer fire companies now in service in the Borough
of Tyrone, namely, the Neptune Fire Company No. 1 and the Blazing
Arrow Hook and Ladder Company and any additional fire companies located
therein which may hereafter be recognized by ordinance of the Borough
of Tyrone, shall together form the Fire Department of the Borough
of Tyrone, Pennsylvania, hereinafter designated the "Fire Department."

A. The Borough Council shall appoint a Borough Fire Marshal, who shall
serve during the pleasure of the Council. The Fire Marshal shall:
(1) Be responsible for building inspection of fire-related matters only,
other fire-prevention measures and the investigation into the cause
of fires.
(2) Advise the Borough Council and report to the Borough Council in all
matters relating to fire prevention and causes of fires.
(3) Render assistance to the Fire Chief when requested by the Fire Chief
and when directed by Council.
B. The Fire Marshal may be given duties by the Council other than those
above prescribed.

No person shall be eligible for the office of Fire Marshal who
has not attained the age of 25 years, nor shall any person be eligible
for any such office who is not a resident of the Tyrone Area School
District, a member of the Tyrone Fire Department for at least five
years, an active, experienced fire fighter in good standing in his
or her company and does not have both basic and advanced firefighting
on the state level and certification in recognition and identification
of hazardous materials. In addition to any other required qualifications
hereinabove set forth, a person appointed as Fire Marshal shall have:
completed no less than 16 hours of fire and arson coursework at the
state or federal level; and must meet all other criteria required
to obtain State Police Fire Marshal Assistant certification.
The Fire Marshal shall keep or cause to be kept complete records
of all fires with information, as prescribed by the Borough Council,
in order to ascertain the cause of fires.
The Fire Marshal shall receive such compensation payable from
the Borough Treasury as may be determined, from time to time, by the
Borough Council.

There is hereby established a Fire Committee consisting of one
Council person, and the duly elected fire chief from each of the fire
companies comprising the Fire Department. The terms of the Fire Committee
members shall run from calendar year to year until and unless any
such member is replaced by the entities making such appointment. The
Fire Committee shall have the authority to determine all disputes
between the fire companies; and discipline and/or suspend any member
of the Fire Department for insubordination or misconduct at any time,
which such discipline and/or suspension shall be honored by the Fire
Company in which the disciplined and/or suspended individual is a
member and upon request hold a hearing with regard to any such action
and either reaffirm or modify its prior decision. Any individual aggrieved
by any decision of the Fire Committee may, within 10 days of any such
decision, appeal the same in writing to the Borough Council.

In the absence of the Fire Marshal, the Fire Chief will assume
the duties of the Fire Marshal.

The Tyrone Borough Fire Marshal, immediately upon his selection
as Tyrone Borough Fire Marshal, shall be an assistant to the Pennsylvania
State Police Fire Marshal.
