A. The Board of Commissioners of the Township of North Versailles hereby
ordains and enacts, by authority of the same, that no person, firm
or corporation shall use, exercise or carry on the trade or business
of buying, selling and dealing in junk automobiles or junk parts,
junk, rope, scrap, iron, glass, lead, brass, copper and rags, bones
and other materials commonly termed as junk, within the limits of
the Township of North Versailles, without having first obtained a
license from the Secretary of the Township of North Versailles, for
which license such person, firm or corporation shall pay to the Treasurer
of the Township of North Versailles the sum of $750, and which license
shall be renewed annually on the first day of January of each year.
B. Each and every person, firm, or corporation desiring to carry on the junk automobiles or junk business within the Township of North Versailles, individually or by the use of a vehicle or vehicles for that purpose, whether the same be accompanied by one or more men, shall obtain a license from the said Secretary of said Township of North Versailles, for each and every such vehicle so used by said person, persons, firm or firms, corporation or corporations in carrying on the business of buying, selling and dealing in junk automobiles or junk parts, junk rope, scrap iron, glass, lead, brass, copper and rags, bones and other materials, commonly termed junk, within the limits of the Township of North Versailles, for each of which said licenses the sum of $300 shall be paid, as provided in Subsection
A hereof.
The premises of all persons, firms or corporations, wherever
the same may be situate, so licensed shall be accessible at all times
to the authorized representative of the Board of Commissioners of
the Township of North Versailles, for the purpose of examining, inquiring
into and searching for any articles and materials which may be received
or purchased under the provisions of this chapter.

Every licensee, or licensees, in the conduct of a junk automobile
or junk business in the Township of North Versailles is, or are, required
and must comply with the following rules and regulations in the conduct
of such duly licensed premises:
A. Every licensed premises must be entirely surrounded by a fence or
barrier which is substantial, solid, and uniform as to appearance,
height, character and substance, which fence or barrier must surround,
encompass, and enclose all junk automobiles and junk within and on
licensed premises. Such fence or barrier must be of the uniform height
of 10 feet at all points thereof; and the fence or barrier shall include
any portion therein that is used as a gate or entrance to said licensed
premises. Where substantial buildings are already constructed to the
property line of the licensed premises, the outer wall on said property
line of such building shall constitute the fence and shall be an exception
to the fence requirement hereunder; provided, however, that said outside
wall of said building is of a height of at least 10 feet.
B. No burning of any junk, refuse, or other substance shall be permitted
at said licensed premises at any time excepting on Wednesday of each
week between the hours of 1:00 p.m. and 5:00 p.m. Eastern standard
time. At no time shall any licensee burn or permit the burning of
any of his junk material or substance outside of the confines or limits
of his licensed premises. Adequate measures and precautions must be
taken by each licensee to control any lawfully permitted burning,
which must be under constant control and supervision of the licensee
or an attendant of said licensee during said burning. At no time shall
any lawfully permitted burning be allowed to become dangerous or hazardous
to surrounding properties or persons.
C. No licensee or licensees shall be permitted to pile or stock any
junk, junk automobiles, or any other materials or substances of his
business on his licensed premises in such manner as to constitute
a hazard, danger or nuisance to persons or property within the Township
of North Versailles, and particularly against any fence or barrier
when the same is adjacent to, at or near public highways or properties
of other persons and in danger of collapsing or otherwise harming
or injuring persons or property of other persons.
D. Every licensee or licensees shall maintain adequate restroom or toilet
facilities on the licensed premises in the conduct of his or their
business.
E. No licensee or licensees shall permit or allow any junk automobiles
or junk of any character to remain on the public highways or streets
of the Township for a longer period than 1/2 hour, in order to reduce
the hazards and dangers to the traveling public. During said 1/2 hour
when said junk automobiles or junk is permitted to remain in any public
highway, it is the exclusive responsibility of the licensee or licensees
to care for, attend to, and adequately safeguard any users of the
highway or any persons from injuries or damages to them or their property
by the presence of said junk automobile or junk of any character in
said highway.
F. The grant or issuance of any license or privilege under this chapter
or any ordinance of the Township of North Versailles shall not permit
or empower such licensee or licensees to maintain a nuisance, nor
shall the grant of such license protect said licensee or licensees
from liability for maintaining a nuisance in the conduct of his or
their business, or for liability for any negligent conduct of said
business.
All persons, firms or corporations so licensed shall keep and
retain on their premises all of such junk automobiles and junk parts,
scrap iron, glass, brass, lead, copper or other metals, and rags,
bones and other materials commonly termed as junk in their original
forms, shapes and conditions for a minimum period of 48 hours, and
shall not dispose of, reduce, change or alter such original forms,
shapes or conditions until such minimum period of 48 hours shall have
passed.

Any person, firm or corporation who shall violate any provision
of this chapter shall, upon conviction thereof, be sentenced to pay
a fine of not more than $1,000, and/or to imprisonment for a term
not to exceed 30 days. Every day that a violation of this chapter
continues shall constitute a separate offense.
