As used in this article, the following terms shall have the meanings indicated:
FIRE OFFICIAL
The Township Fire Marshal or his designee.
PLAYGROUND AREA
A place with a specific design for children to be able to play, or any other area specifically designated as a playground.
PROHIBITED AREAS
Any playground area, pavilion area, dog park, and/or skateboard park within the Township Community Park, any Township-owned park or any area within 50 feet of any of these areas.
SMOKING
Includes possession of a lighted cigarette, cigar, pipe or other lighted smoking instrument.
TOBACCO USE
Includes smoking and the use of smokeless tobacco or tobacco products in any form.
Smoking and tobacco use in any form is prohibited in the areas herein provided, and such use shall be unlawful and a violation of this article.
A. 
The Fire Official is empowered to post no-smoking signs in and around all areas, parks, playgrounds, or pavilions herein designated in which smoking and tobacco use is prohibited hereby. The content, lettering, size, color and location of required no-smoking signs shall be subject to the approval of the Fire Official.
B. 
It shall be unlawful for any person to obscure, remove, deface, mutilate or destroy posted no-smoking signs.
Any person who violates or permits a violation of this article shall be subject to a civil enforcement proceeding and, upon conviction, shall be sentenced to pay a civil penalty of not more than $600, plus all court costs, including reasonable attorneys' fees, incurred by the Township in the enforcement of this article. Each day a violation exists shall constitute a separate offense. Further, the appropriate officers or agents of the Township are hereby authorized to file a complaint for summary violation and seek any other available relief at law or equity, including injunction, to enforce compliance with this article.
