A certain document, three copies of which are on file in the office of the Township Clerk of the Township of Berlin, being marked and designated as the "BOCA Basic National Existing Structures Code for 1984," as published by the Building Officials and Code Administrators International, Inc., be and is hereby adopted as the Building Code of the Township of Berlin, in the County of Camden and State of New Jersey, for the control of buildings and structures as herein provided, and each and all of the regulations, provisions, penalties, conditions and terms of the BOCA Basic National Existing Structures Code for 1984 are hereby referred to, adopted and made a part hereof as if fully set out in this article, with the additions, insertions, deletions and changes, if any, prescribed in §
103-2 of this article.
The following sections are hereby revised as follows:
A. Section 100.1 (second line): Insert "Township of Berlin."
B. Section 100.1 (fifth line): Insert "Township of Berlin."
C. Section 105.1: Insert "the date of adoption of the Code of the Township
of Berlin."
D. Section 107.1: Insert "Township of Berlin."
E. Section 118.4: Insert "$1 per $100 of assessed valuation."
F. Section 118.5: Insert "$50."
G. Sections 122.3 and 123.2 are hereby deleted and replaced by the following:

Any person violating or failing to comply with any of the provisions
of this article or the code adopted hereby shall, upon conviction
thereof, be punishable by a fine of not more than $500 or by imprisonment
in the county jail for a term not to exceed 90 days, or both, in the
discretion of the court. The continuation of such violation for each
successive day shall constitute a separate offense, and the person
or persons allowing or permitting the continuation of the violation
may be punished as provided above for each separate offense.

H. Section 126.3 is hereby deleted and replaced by the following:

The repair, closing or demolition of dwellings deemed to be unfit for human habitation shall be performed as is provided by Chapter 112, Buildings, Unfit, of the Code of the Township of Berlin.

A. All persons or owners of property intending to demolish a structure
of a size more than 500 square feet shall notify all property owners
within 100 feet of the property line on which the structure is located
at least 10 days prior to the date of demolition. All persons or property
owners engaged in demolition of any such structure shall follow all
guidelines, procedures and requirements developed by the Occupational
Safety and Health Administration.
B. Violations and penalties. Any person violating the provisions of Subsection
A or failing to comply therewith shall, upon conviction thereof, be punishable by a fine of $1,000 or by imprisonment in the county jail for a term not to exceed 90 days, or both, in the discretion of the court.

A. All applicants for residential construction permits shall have the
application reviewed by the Township Construction Official and/or
Township Engineer to determine whether a topography and grading plan
is required to be filed as part of the approval process by the Township
for the issuance of a construction permit. A topography and grading
plan shall be a mandatory requirement for construction in connection
with all major subdivisions. For minor subdivisions and individual
lots, the determination of whether a topography and grading plan is
required shall rest with the Township Construction Official and/or
Township Engineer.
B. In the event a topography and grading plan is required, the applications
shall be reviewed and approved by the Township Engineer. All lots
shall undergo a final inspection of the grading, to be performed by
the Township Engineer. Following final inspection of the site, a written
report shall be prepared by the Township Engineer.
C. The lot grading plan must be prepared by a New Jersey state licensed
land surveyor and New Jersey licensed professional engineer. All proposed
grading plans shall be prepared to avoid an adverse impact on all
adjoining or adjacent properties. The plan must depict the following
items:
(1) Outbounds and topographic survey, including the depiction of any
existing or proposed easements. The topography shall include contours
at one-foot intervals and spot elevations at all property corners,
low or high points and other distinct topographic features.
(2) All zoning setback lines and proposed building setbacks.
(3) Location and elevation of all existing improvements and/or utilities
and all proposed improvements, including, but not limited to, accessory
buildings, curbs, sidewalks, driveways, patios, decks, pools, fences
and utility service lines.
(4) Proposed building basement and floor elevations, proposed contour
lines at one-foot intervals and proposed spot elevations shall be
shown at building corners, proposed swale, curb, sidewalk and driveways.
(5) When curb and sidewalk is proposed along a street, the grading plan
shall also include spot elevations along the center line, edge of
paving, proposed gutter line and top of curb and sidewalk at intervals
no greater than 50 feet. A profile depicting these elevations and
proposed design shall be included with the grading plan.
(6) Existing and proposed contour lines and spot elevations of the parcel,
as noted above, and for 50 feet surrounding the parcel.
(7) Elevations of proposed ground, garage floor, top of block and floor
elevation for the proposed dwelling.
(8) The location and elevation of buildings on adjacent lots.
(9) All wetlands and wetlands buffers.
D. The fee(s) payable hereunder shall be as set forth in Chapter
156, Fees.

A. All applicants for construction permits shall submit an application
for a foundation location plan review and inspection. The applications
shall be reviewed and approved by the Township Engineer. All lots
shall undergo a final inspection of the foundation location, to be
performed by the Township Engineer. Following final inspection of
the site, a written report shall be prepared by the Township Engineer.
B. The foundation location plan must be prepared by a licensed land
surveyor and depict the lot lines of the parcel and the tie distances
from the property lines to the building. The plan must note the elevation
of the top of the foundation wall or slab.
C. The fee(s) payable hereunder shall be as set forth in Chapter
156, Fees.
