The salaries of officers and employees for which compensation is not otherwise provided shall be as set forth in the annual Salary Ordinance.[1]

Any fees or costs for services rendered by any officer or employee or agent of the Township of Berlin shall be paid to said Township and deposited in the appropriate Township account. No fees or costs for any services rendered shall be payable to any officer, employee or agent.

The purpose of this article shall be to establish eligibility for participation in the Defined Contribution Retirement Program and other retirement programs as established.
Effective July 1, 2007, the following positions or persons employed by the Township shall be eligible for and shall participate in the Defined Contribution Retirement Program:

Director of Public Works (unless certified);
B. 
Municipal Court Judge;
C. 
Municipal Court Administrator;
D. 
Municipal Prosecutor;
E. 
Property Maintenance Inspector;
F. 
Board of Health Inspector;
G. 
Zoning Officer;
H. 
Librarian;
I. 
Emergency Management Coordinator;
J. 
Grants Coordinator;
K. 
Chief Financial Officer;
L. 
Township Clerk;
M. 
Tax Assessor;
N. 
Tax Collector;
O. 
Fire Subcode Inspector;
P. 
Construction Code Official;
Q. 
Building Inspector;
R. 
Plumbing Inspector;
S. 
Electrical Subcode Official/Electrical Inspector.
A. 
A person who is otherwise eligible for membership in the Teacher's Pension and Annuity Fund or the Police and Firemen's Retirement System shall not be eligible to participate in the Defined Contribution Retirement Program.
B. 
If the individual meets any of the following exceptions, the individual's participation in the Defined Contribution Retirement Program shall not be mandatory, and that individual may be permitted to join or remain in the Public Employees' Retirement System:
(1) 
The individual holds a professional license or certificate to perform and is serving in any of the following capacities, regardless of the position held:
(a) 
Certified Health Officer;
(b) 
Tax Collector;
(c) 
Chief Financial Officer;
(d) 
Construction Code Official;
(e) 
Registered Municipal Clerk;
(f) 
Tax Assessor;
(g) 
Licensed Uniform Subcode Inspector;
(h) 
Certified Public Works Manager.
(2) 
The individual is appointed to a temporary or interim "acting" capacity to a Defined Contribution Retirement Program position that otherwise requires a professional license or certification as noted in Subsection B(1) above.
(3) 
The individual was a member of the Public Employees' Retirement System prior to July 1, 2007, and has continuously been a member since that time, i.e., a period of no more than two years has elapsed from the time the individual left employment in a Public Employees' Retirement System position to the time the person was reemployed.
