The Marlborough Township Police Department or the Township Building
Code Official may enforce the provisions of this chapter. Both shall
exercise general supervision over persons occupying or using the parks.
Any person who violates or permits a violation of this chapter shall,
upon conviction in a summary proceeding brought before a Magisterial
District Judge under the Pennsylvania Rules of Criminal Procedure,
be guilty of a summary offense and shall be punishable by a fine of
not more than $1,000, plus costs of prosecution. In default of payment
thereof, the defendant may be sentenced to imprisonment for a term
not exceeding 90 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate
offense, and each section of this chapter that is violated shall also
constitute a separate offense.[1]
The Marlborough Township Police Department and any other official
law enforcement agency shall have such authority as is conferred by
the laws of the Commonwealth of Pennsylvania. The Township authorizes
any member of its Police Department to enforce these rules and regulations.
Violations of any of the rules and regulations herein may result
in the revocation of any permits or approvals granted for the use
of any park. Any person who shall violate any regulation relating
to the parking of a vehicle within any park shall be notified by the
Police Department of such violations, said notice to be served by
affixing a written ticket or notice upon the vehicle unlawfully parked
or by personally serving the owner or operator of the vehicle.
