GENERAL REFERENCES
Towing and impounded vehicles — See Ch. 80.
No person shall abandon any vehicle within the Village or on Village property within or without the corporate limits, and no person shall leave any vehicle at any place within the Village or on Village property within or without the corporate limits for such time and under such circumstances as to cause the vehicle reasonably to appear to have been abandoned.
No person shall leave any partially dismantled, nonoperating, wrecked, or junked vehicle on any street or highway within the Village or on Village property within or without the corporate limits, provided the vehicle may be left at a place authorized by the Village for the dumping and disposal of garbage and rubbish in accordance with the ordinances of the Village and the rules and regulations governing such dumping ground.

A. 
No person in charge or control of any property other than Village property within the Village, or other than persons or entities operating a business enterprise in a lawful operation of such business enterprise, shall allow any partially dismantled, nonoperating, wrecked, junked or discarded vehicle to remain on the property longer than 30 days. No person shall leave any vehicle on Village property within or without the corporate limits longer than 48 hours. No person or entity shall allow any partially dismantled, nonoperating, wrecked, junked or discarded vehicle to remain on the property of the business enterprise operated in a lawful operation of such business enterprise longer than 60 days. This chapter shall not apply to a vehicle in an enclosed building or a vehicle in an appropriate storage place or depository maintained in a lawful place and manner by the Village.
B. 
This section shall not apply to lawfully operated auto junkyards, as defined by the ordinances of the Village.
A. 
The Chief of Police is authorized to remove or have removed any vehicle left at any place within the Village or on any Village property within or without the corporate limits which reasonably appears to be in violation of this chapter or lost, stolen, or unclaimed.
B. 
The vehicle in violation of this chapter shall be impounded until lawfully claimed or disposed of in accordance with state law and provisions of this chapter. However, no vehicle shall be removed and impounded as provided herein until the Chief of Police has given written notice of his or her intention to impound the vehicle within 10 days from the date of the notice, if the vehicle has not been removed at the end of such time. A notice shall be given by:
(1) 
Affixing the notice on the vehicle;
(2) 
Sending notice by mail to the owner of the vehicle at his or her last known address if the owner is reasonably ascertainable; or
(3) 
Sending notice by mail to the person owning or controlling the property on which the vehicle is located.
C. 
The Chief of Police may enter upon private property at all reasonable hours for the purpose of inspecting a vehicle, posting notice thereon, and removing and impounding the vehicle. It shall be unlawful for any person to prevent the Chief of Police from entering on private property for purposes of carrying out his or her duties hereunder or to interfere with him or her in the lawful performance of his or her duties under the provisions of this chapter.
D. 
The Chief of Police may tow, or cause to be towed, to a suitable storage area any vehicle abandoned, parked, or otherwise kept in violation of the provisions of this chapter.
The owner of or person abandoning, parking or otherwise keeping a vehicle in violation of this chapter which is impounded under this chapter shall be charged a sufficient fee to cover expenses of impounding and enforcement of this chapter. This fee may be collected by the Village in an action at law and must be paid prior to the release of the vehicle impounded. This fee shall be in addition to the fine provided for herein for the violation of this chapter. Unclaimed vehicles may be sold at public auction by the Village pursuant to ILCS Ch. 625, Act 5.

For purposes of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning:
ABANDONED VEHICLE
Any vehicle in a state of disrepair rendering the vehicle incapable of being driven in its condition or any vehicle that has not been moved or used for seven consecutive days or more and is apparently deserted.

Whoever violates any provisions of this chapter for which no other penalty is specified shall be subject to the penalty set forth in § 10-99 of the Code.
