There is hereby established, pursuant to Chapter 291, P.L. 1975, in the Township of Eagleswood a Land Use Board of nine members, consisting of the following classes:
A. 
Class I, the Mayor, or the Mayor's designee in the absence of the Mayor.
B. 
Class II, one of the officials of the municipality other than a member of the governing body to be appointed by the Mayor.
C. 
Class III, a member of the governing body to be appointed by it.
D. 
Class IV, six other citizens of the municipality to be appointed by the Mayor.

Pursuant to N.J.S.A. 40:55D-23.1, the Mayor shall appoint four alternate members to the Land Use Board, who shall meet the qualifications for Class IV members. The four alternate members shall be designated at the time of appointment as "Alternate No. 1," "Alternate No. 2," "Alternate No. 3" and "Alternate No. 4." The terms of the alternate members shall be for two years; since four alternate members will be appointed, the term of not more than two alternate members shall expire in any one year; and provided further that in no instance shall the terms of the alternate members first appointed exceed two years. A vacancy occurring otherwise than by expiration shall be filled by the Mayor for the unexpired term only. Alternate members may participate in discussion of the proceedings but may not vote except in the absence or disqualification of a regular member. In the event that a choice must be made as to which alternate member is to vote, Alternate No. 1 shall be the first to vote and then the alternates thereafter, based upon their designation, as needed.

A. 
The term of the member composing Class I shall correspond to the Mayor's official tenure or, if the member is the Mayor's designee in the absence of the Mayor, the designee shall serve at the pleasure of the Mayor during the Mayor's official tenure. The term of the members composing Class II and Class III shall be for one year or terminate at the completion of their respective terms of office, whichever occurs first.

B. 
The terms of the Class IV members shall be for four years, except that the first two members appointed pursuant to this chapter shall be for one year, the third and fourth members for two years, the fifth member for three years and the sixth member for four years.
If a vacancy for any class shall occur otherwise than by expiration of term, it shall be filled by appointment as above provided for the unexpired term.
The Land Use Board shall organize and conduct its business pursuant to N.J.S.A. 40:55D-24 and exercise the powers granted to it pursuant to N.J.S.A. 40:55D-25 et seq.

In addition to its Land Use Board powers, the Land Use Board shall exercise, to the same extent and subject to the same restrictions, all the powers of the Board of Adjustment pursuant to N.J.S.A. 40:55D-70 et seq., but the Class I and Class III members shall not participate in the consideration of applications for development which involve relief pursuant to N.J.S.A. 40:55D-70(d).

The Land Use Board Secretary shall publish a brief notice of each decision of the Land Use Board in the official newspaper of the municipality or in the newspaper of general circulation in the municipality. The costs incurred by the Board in making such publication shall be the responsibility of the applicant and shall be deducted from the applicant's escrow.
