A Municipal Court for the Township is established pursuant to the provisions of N.J.S.A. 2B:12-1 et seq.

The name of the Municipal Court shall be the "Municipal Court of the Township of Eagleswood in the County of Ocean."
The Municipal Court shall have a Seal, which shall bear the impress of the name of the court.
There shall be a Municipal Court Judge of the Municipal Court, who shall be appointed by the Township Committee and who shall serve for a term of three years from the date of his appointment and until his successor is appointed and qualified.

The Municipal Court Judge shall receive an annual salary to be paid in the same manner as the salaries of other Township officers are paid, and which shall be in lieu of all fees, costs and other allowances whatsoever.

The Municipal Court and the Municipal Court Judge thereof shall have, possess and exercise all the functions, powers, duties and jurisdiction conferred by the provisions of N.J.S.A. 2B:12-1 et seq., as amended and supplemented, or by any other law.

There shall be a Municipal Court Administrator, who shall be approved by the Township Committee and who shall serve for a term of one year from the date of appointment and until his successor is appointed and qualified. The Administrator of the Municipal Court shall receive an annual salary to be paid in the same manner as the salaries of other Township officers are paid, and which shall be in lieu of all fees, costs and any other allowances whatsoever. He shall perform such functions and duties as shall be prescribed for him by law, the rules applicable to municipal courts and by the Municipal Court Judge.

There is hereby created the position of Deputy Municipal Court Administrator of the Municipal Court of the Township of Eagleswood. Said Deputy Municipal Court Administrator shall be appointed by the governing body of the Township of Eagleswood. Said Deputy Administrator shall serve for a term of one year from the date of appointment until a successor is appointed and qualified. The Deputy Municipal Court Administrator of the Municipal Court of the Township of Eagleswood will receive an annual salary, which shall be fixed by the Township Committee of the Township of Eagleswood. Said salary shall be paid in the same manner as the salaries of other municipal officers and employees are paid. Said salary shall be paid in lieu of any fees, costs and allowances whatsoever. Said Deputy Municipal Court Administrator shall perform such functions and duties as shall be prescribed for said Deputy Municipal Court Administrator by law, the rules applicable to municipal courts and by the Judge of the Municipal Court.

All requests for discovery in matters pending in the Township of Eagleswood Municipal Court shall be submitted through the Municipal Prosecutor. Provision of discovery materials and the fees charged for same shall be made in accordance with New Jersey Rule of Court 7:7-7.

Pursuant to N.J.S.A. 2B:24-17, the Township of Eagleswood shall require any person applying for representation by the Municipal Public Defender to pay an application fee as set forth in Chapter 135, Fees. The Municipal Court may waive any required application fee, in whole or in part, if the Court determines, in its discretion, that the application fee represents an unreasonable burden on the person seeking representation.

A. 
There is hereby created the position of Municipal Court Officer.
B. 
The Township Committee of the Township of Eagleswood may appoint a Municipal Court Officer in its sole discretion as it deems necessary. The term of such office shall be for one year, commencing January 1 of each year and ending on December 31, or until a successor is appointed. Should the office become vacant during any term, it shall be filled by similar appointment but for the unexpired term only.
C. 
The Municipal Court Officer shall be required to attend all Municipal Court sessions to ensure the peace and good order of same.
D. 
The compensation of the Municipal Court Officer shall be fixed by the annual salary ordinance of the Township of Eagleswood. Any additional fees shall be approved by the Township Committee.
