In order to provide economical and efficient, overall direction, coordination and control of the day-to-day activities of the Village of Chittenango, to provide centralized direction and control of Village employees, to reduce the attention to administrative details currently performed by the Mayor and Trustees, and to enable the Mayor and Trustees to have greater opportunity for the proper consideration of policy matters, the position of Village Administrator is hereby established for the Village of Chittenango. To avoid disruption of Village business during periods of temporary absences or temporary disability of the Village Administrator, the position of Acting Village Administrator is hereby authorized.
Pursuant to Village Law § 3-301(2)(c), and upon a determination that the best interests of the Village would be served by the appointment of a Village Administrator, a Village Administrator may be appointed by the Mayor, subject to approval by the Board of Trustees. A Village Administrator shall serve for a term of up to four year, to coincide with the term of the Mayor for whose term the Administrator is appointed. The person designated as Village Administrator must be, or must become within four months of taking office, a legal resident of the Village of Chittenango. The position shall be exempt, unclassified and noncompetitive. In the case of vacancy in this office, and upon direction to fill the vacancy by the Board of Trustees, the Mayor shall appoint another Village resident, or person who must become a Village resident within four months of appointment, to fulfill the remaining term of the Village Administrator [Village Law § 3-312(3)(a)]. The Board of Trustees shall fix the compensation of the Village Administrator.

A. 
The Village Administrator shall report to, and be under the supervision of, the Mayor and the Board of Trustees.
B. 
The position of Deputy Village Administrator is hereby established.
C. 
The Deputy Village Administrator shall be appointed by the Board of Trustees, upon the recommendation of the Mayor. The Deputy Village Administrator shall remain in such position at the pleasure of the Board of Trustees and shall receive such compensation as the Board of Trustees shall fix.
D. 
During the absence or disability of the Village Administrator, the Deputy Village Administrator shall assume the responsibilities and act for and on behalf of the Village Administrator.

Subject to the approval, direction and control of the Mayor and Board of Trustees, or in those instances where approval, direction and control is, by applicable law, reserved to the Mayor, then subject to the approval, direction and control of the Mayor, and in accordance with such law and such policies, orders, rules, regulations, resolutions, ordinances and local laws as may be promulgated or adopted by the Board of Trustees, the Village Administrator shall:
A. 
Supervise and coordinate the activities of all Village departments;
B. 
Oversee, assist and coordinate the work of all Village employees and implement the personnel policies, orders, rules, regulations, resolutions, ordinances and local laws of the Village, in conjunction with the appropriate department heads, if applicable;
C. 
Recommend appointments, promotions or dismissal of Village employees in accordance with applicable policies, orders, rules, regulations, resolutions, ordinances and local laws of the Village, in conjunction with the appropriate department heads, if applicable;
D. 
Oversee the enforcement of the policies, orders, rules, regulations, resolutions, ordinances, and local laws of the Village, and other applicable laws, in an efficient and impartial manner;
E. 
When so designated by the Mayor, prepare, as budget officer, the tentative budget according to law;
F. 
Control expenditures within the amounts appropriated in the budget, by developing, putting in place and enforcing administrative controls;
G. 
Regularly report the financial condition of the Village to the Broad of Trustees and, periodically, recommend needed action;
H. 
Supervise, assist and coordinate the process of purchasing all materials, supplies and equipment and the letting of all bids and contracts;
I. 
Maintain an ongoing study of all activities and functions of the Village, with a view to making recommendations, from time to time, of measures and programs which might improve the efficiency and effectiveness of Village government operations;
J. 
Consult with appropriate Village officers and employees in the preparation of policies, orders, rules, regulations, resolutions or local laws;
K. 
Recommend for adoption such measures as the Village Administrator may deem necessary, appropriate or expedient for the health, safety or general welfare of Village residents, or for the improvement of the delivery of government services;
L. 
Attend all meetings of the Board of Trustees and provide information relative to agenda items;
M. 
Maintain systems and practices whereby Village residents are informed of Village policies, procedures and plans for the delivery of governmental services;
N. 
Oversee the expeditious response to inquiries by Village residents, or other interested persons, concerning Village government, operations and services;
O. 
Maintain liaison with other government entities and administrative agencies, but not as a substitute for the Mayor or Trustees, as the official representatives of the Village;
P. 
The Village Administrator may not also be appointed to serve simultaneously as Village Clerk, Village Treasurer, or Deputy Village Clerk, or Deputy Village Clerk-Treasurer; and
Q. 
Perform and discharge such other duties and responsibilities as may, from time to time, be assigned by the Mayor and Board of Trustees.
Nothing herein shall be deemed or construed as transferring or limiting, in any way, any powers, duties or responsibilities of the Mayor, Trustees, or other Village officers or employees, as are prescribed by the law, rule and regulation of the State of New York, or by the policies, orders, rules, regulations, resolutions or local laws of the Village of Chittenango.

Subject to the approval, direction and control of the Village Administrator, or in those instances where approval, direction and control is, by applicable law, reserved to the Mayor, then subject to the approval, direction, and control of the Mayor, and in accordance with such law and such policies, orders, rules, regulations, resolutions, ordinances, and local laws as may be promulgated or adopted by the Board of Trustees, the Deputy Village Administrator shall have the following powers and duties:
A. 
The Deputy Village Administrator shall provide recommendations to the Village Administrator regarding the jurisdiction, supervision and control over the administration, disposition and discipline of the officers and members of the Police Department. The Deputy Village Administrator shall further provide recommendations to the Village Administrator regarding the government, maintenance and direction of the building(s) of the Police Department and equipment furnished therefor, and shall provide recommendations to the Village Administrator relative to the general direction and supervision of the expenditure of moneys appropriated to the Police Department.
B. 
The Deputy Village Administrator shall recommend rules and regulations to the Board of Trustees regarding the government, administration, disposition and discipline of the members of the Police Department. Such rules and regulations may provide for the hearing, examination, investigation and determination of charges made or prepared against any officer or member of said Department for neglect of official duty or incompetency or incapacity to perform their official duties, or some delinquency seriously affecting his/her general character or fitness for the office.
C. 
The Deputy Village Administrator shall, in consultation with the Chief of Police, provide recommendations to the Board of Trustees for the appointment of officers and members of the Police Department, subject to civil service rules and regulations, for such positions as are established by the Board of Trustees.
D. 
The Deputy Village Administrator shall have general supervision over the records of the Police Department and its officers and employees and shall possess such other powers and perform such other duties as may be prescribed by law or by resolution of the Board of Trustees.
E. 
The Deputy Village Administrator shall assist the Village Administrator in the administration of flood, disaster, and other emergency plans.
