Amendments to the City of Lancaster Zoning Ordinance or Zoning Map shall be in accordance with the following:
All persons other than the Planning Commission desiring to amend the Zoning Ordinance or Zoning Map shall file an application for zoning map or text amendment with the Zoning Officer and submit the filing fee stipulated by City Council resolution. The Zoning Officer shall forward the application to the City Clerk.
In the case of an amendment other than that prepared by the Planning Commission, the City Council shall submit each such amendment to the Lancaster City Planning Commission at least 30 days prior to the hearing conducted by the City Council on such proposed amendment to provide the Planning Commission an opportunity to submit comments and recommendations.
In the case of an amendment prepared by the City Administration and/or Lancaster City Planning Commission, the Commission, at a public meeting, will formally recommend to City Council approval or denial of an amendment. Recommendations and comments shall be forwarded to the Council within 30 days of the Commission's meeting.
At least 30 days prior to the public hearing on the amendment by the City Council, the City of Lancaster shall submit the proposed amendment to the Lancaster County Planning Commission for recommendations along with a fee, paid by the applicant, in accordance with the latest County fee schedule.
Before voting on the enactment of an amendment, the City Council shall hold a public hearing thereon, pursuant to public notice. In addition, if the proposed amendment involves a Zoning Map change, notice of said public hearing shall be conspicuously posted by the City of Lancaster at points deemed sufficient by the City along the perimeter of the tract to notify potentially interested citizens. The affected tract or area shall be posted at least one week prior to the date of the hearing.
If, after any public hearing held upon an amendment, the proposed amendment is changed substantially, or is revised to include land previously not affected by it, the City Council shall hold another public hearing, pursuant to public notice, before proceeding to vote on the amendment.
Within 30 days after enactment, a copy of the amendment shall be forwarded to the Lancaster County Planning Commission.
