As used in this chapter, the following terms shall have the meanings indicated:
CLOTHING DONATION BIN
Any receptacle or container made of metal, steel, or any other material designed for the collection and temporary storage of donated clothing or other materials.
Clothing donation bins or similar storage containers (hereinafter referred to as "bins") are prohibited in the Township of Brick.
Registered nonprofit organizations are permitted to place used clothing bins on nonresidential property in accordance with the following:
A. 
Developed nonresidential commercial premises in the B-2 and B-3 Business Zones and developed property devoted to charitable nonprofit purposes, including but not limited to civic and religious organizations, are permitted to have up to two used clothing donations bins.
B. 
The bin(s) shall be appropriately located so as not to interfere with sight triangles, on-site circulation, required setbacks, landscaping, required parking, and any other requirements that may have been imposed as part of the site plan approval for the premises.
C. 
The bin(s) shall be of the type that are enclosed by use of a receiving door and locked so that the contents of the bin(s) may not be accessed by anyone other than those responsible for the retrieval of the contents.
D. 
Each bin shall not cover a ground surface area in excess of five feet by five feet, nor be more than six feet in height.
E. 
Each bin must be regularly emptied of its contents so that it does not overflow, resulting in used clothing being strewn about the surrounding area.
F. 
Bin shall be located on a dust-free, durable surface.
An annual permit for used clothing bins for each proposed location shall be required from the Township Clerk, but can only be granted when it is determined by the Zoning Officer and Township Planner that:
A. 
The annual fee for a permit for used clothing bins shall be $25 for each proposed property.
B. 
The bin(s) are for use and/or benefit of a duly registered nonprofit charitable or religious organization.
C. 
The proper types of bin(s) are being used as described by this section.
D. 
The bin(s) are being placed in a proper location as described by this section.
E. 
There is a letter of authority/permission from the owner of the property upon which the bins are to be and/or are already located.
F. 
There is a letter of authority/permission from the nonprofit, charitable organization or religious group to locate a bin on the subject property.
G. 
The name, address and phone number of the nonprofit, charitable organization or religious group shall be displayed on each bin.
The location or relocation of used clothing bins may be approved by the Planning or Zoning Board during consideration of an application for site plan approval. Such approval would not result in an exemption from the requirements of this chapter.
A. 
This chapter shall take effect 90 days after its adoption.
B. 
Violations and penalties. Any person violating or failing to comply with any of the provisions of this chapter shall, upon conviction thereof, be punishable by a fine of not more than $2,000, by imprisonment for a term not to exceed 90 days or by community service of not more than 90 days, or any combination of fine, imprisonment and community service as determined in the discretion of the Municipal Court Judge. The continuation of such violation for each successive day shall constitute a separate offense, and the person or persons allowing or permitting the continuation of the violation may be punished as provided for each separate offense.
