A. 
No person, group of persons, partnership, association, or corporation, or any combination thereof, or any owner of real estate situated within said municipality shall maintain or construct, promote, permit to be operated or operate on any lands or premises within the Borough of Slippery Rock, Butler County, Pennsylvania, other than in established theaters, auditoriums, or other places licensed, constructed, regulated, or permitted by public occupancy in accordance with local and state regulations, ordinances and fire codes, any public theatrical or musical performance, including but not limited to pop festivals, rock music festivals, rock festivals, jazz festivals, rock-and-roll music festivals, or any combination thereof, except pursuant of a permit issued therefor by the Borough of Slippery Rock, Butler County, Pennsylvania, as hereinafter provided.
B. 
No owner, lessee, licensee, or any other person, partnership, association or corporation having any right to or interest in, by deed, lease, easement, or any other manner, any real property within the municipality of Slippery Rock Borough, Butler County, Pennsylvania, shall license, rent, lease, or permit the use of such real property, or any part thereof, for the use of public theatrical or musical entertainment or participation therein, other than in established theaters, auditoriums, or other places licensed, constructed and established for public occupancy in compliance with local and state regulations, except pursuant to a permit issued as hereinafter provided.
A. 
The Administrator/Secretary of the Borough of Slippery Rock, Butler County, Pennsylvania, may issue a permit upon written application made by such person, partnership, association or corporation, or combination thereof, who proposed to maintain, construct, promote, or operate any public musical or theatrical entertainment or participation therein, and the owner, lessor, or licensor who proposes to rent, lease, license, or otherwise permit such musical or theatrical entertainment or participation therein on real estate which he controls, and such applicants shall jointly be responsible for the operation of any such performance and for compliance with the provisions of this chapter.
B. 
The applicants for a permit as herein provided shall file a verified application with the Administrator/Secretary of Slippery Rock Borough, Butler County, Pennsylvania, at least 60 days prior to the dates upon which said event is to take place.
C. 
Before any person, group of persons, partnership, association, corporation, owner of real estate, lessor, or licensor shall be issued a permit for performance of musical or theatrical entertainment, in accordance with provisions of this chapter, it will pay to Slippery Rock Borough, Butler County, Pennsylvania, a permit fee in an amount as set from time to time by resolution of the Borough Council. Said permit fee shall cover the costs of inspection of premises and enforcement of this chapter. All requirements of this chapter shall be completed at least 10 days prior to the scheduled event so that health, law enforcement, zoning and building and plumbing inspectors can complete their inspection prior to issuance of the permit.[1]

D. 
The applicants shall show:
(1) 
The number of persons expected to attend such event and a plan of the location thereof. Said plan shall conform to the requirements herein.
(2) 
The date or dates of said performance or gathering.
(3) 
The duration of the event.
(4) 
Facilities for toilet and other personal sanitary needs for men and women, with one separate toilet facility for each 100 persons to be accommodated. Said toilet facilities shall be connected to the municipality sewer services and water supply.
(5) 
Parking space shall be designated on the plan to be submitted with the application, with at least one parking space for every five persons to be accommodated. Said parking spaces shall be adequately lighted, of gravel or paved surface to prevent creation of dust clouds and with ingress and egress roadways adequate to prevent excessive traffic accumulation on public thoroughfares of the municipality.
(6) 
Emergency first aid facilities shall be provided with a registered medical doctor, at least one nurse and ambulance available at the scene.
(7) 
Sleeping accommodations and shelters shall be provided for any performance or function which is to be continued from 12:00 midnight until 6:00 a.m.
(8) 
Restaurant and food facilities and services shall be provided, and such facilities shall comply with state and local health laws, and all necessary permits shall be obtained.
(9) 
Adequate safety guards and special police shall be hired and under contract to supervise the persons attending the event and to provide traffic direction and control within the parking area and at exits and entrances from roadways of the municipality.
(10) 
A copy of the written lease, permit or license from the landowner to the sponsor of the performance shall be attached to the application.
(11) 
A cash bond in the amount of $10,000 shall be posted with the municipality to insure compliance with all of the terms of this chapter and the complete cleanup and restoration of the area after the performance has been held.
(12) 
Proof of liability coverage insurance by both the owner, lessor or licensor of the land and the sponsor of the event shall be provided to the municipality with coverage up to $300,000 for each claim and $1,000,000 total coverage.[2]

This chapter shall not be applicable in cases where there are to be less than 500 people attending any event and where such event does not continue beyond 12:00 midnight, and provided further that the Borough of Slippery Rock, Butler County, Pennsylvania, Police Department is notified of said event at least 48 hours in advance thereof by written notice and approves such event.
The owner, lessor, or licensor of any performance or gathering covered by this chapter shall comply with all local ordinances, state and federal laws and shall ensure by bond posted that local and state laws are not violated by said gathering or any participation therein.

Any person who violates or permits a violation of this chapter shall, upon being found liable therefor, pay a fine of not more than $600, plus court costs and reasonable attorneys' fees incurred by the Borough in the enforcement proceedings. If the penalty is not paid, the Borough shall initiate a civil action for collection in accordance with the Pennsylvania Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense, and each section of this chapter that is violated shall also constitute a separate offense. In addition to or in lieu of enforcement under this section, the Borough may enforce this chapter in equity in the Court of Common Pleas of Butler County.
