Unless the particular activity is exempted by this regulation,
a person may not perform a land disturbance activity, develop or redevelop
land or create new impervious surface without first obtaining a permit
from the Department. Prior to issuance of any permit, the County Engineer
shall review and approve all information related to stormwater management
as may be required of a developer under the terms of this chapter.
The County Engineer may, at any phase of the process, request any
additional information needed to support the design, which may include,
but not be limited to, plans, calculations, notes, studies, details,
tables, reports, professional certifications, etc. The County Engineer
shall have final authority over all engineering and technical interpretations
of the stormwater management requirements established in this chapter.
A permit may not be issued for redevelopment, a land disturbance
activity, a development, or creation of a new impervious surface unless
a concept stormwater management plan, a site stormwater management
plan and a final stormwater management plan have been approved that
are consistent with:
A. The Stormwater Management Subtitle;
B. The Charles County Stormwater Management Ordinance;
D. Policies, procedures or any other requirement established by the
Department; and
E. Code of Maryland Regulations (COMAR) 27.01.02.03D, titled "Intensely
Developed Areas."
