The International Property Maintenance Code, 2012 Edition, is hereby adopted as the Existing Structures Code of the City for the control of buildings and structures within the City. Each and all of the regulations, provisions, penalties, conditions and terms of the code are hereby adopted by reference and made a part of this Article as if fully set out in this Article, with the additions, insertions, deletions and changes, if any, prescribed in Section 500.090. One (1) copy of the International Property Maintenance Code, 2012 Edition, is on file in the office of the City Clerk.

The 2012 International Property Maintenance Code is amended
in the following respects:
Section PM 101.1 is hereby amended to read as follows:
Section 101.1. This code shall be known as the
"Property Maintenance Code of the City of Osage Beach, Missouri,"
hereinafter referred to as the "Property Maintenance Code" or "this
code."
Section 103.5: delete in its entirety.
Section 302.4: insert the words "twelve (12) inches."
Section 304.14. During the period from May 1 to
October 1, every door, window and other outside opening required for
ventilation of habitable rooms, food preparation areas or any areas
where products to be included or utilized in food for human consumption
are processed, manufactured, packaged or stored shall be supplied
with approved tightly fitting screens of a minimum of 16 mesh per
inch (16 mesh per 25 mm), and every screen door used for insect control
shall have a self-closing device in good working condition.
Section 602.3. Heat Supply. Every owner and operator
of any building who rents, leases or lets one or more dwelling units
or sleeping units on terms, either expressed or implied, to furnish
heat to the occupants thereof shall supply heat during the period
from October 1 to May 1 to maintain a minimum temperature of 68°F
(20°C) in all habitable rooms, bathrooms and toilet rooms.

When the outdoor temperature is below the winter outdoor design
temperature for the locality, maintenance of the minimum room temperature
shall not be required, provided that the heating system is operating
at its full design capacity. The winter outdoor design temperature
for the locality shall be as indicated in Appendix D of the International
Plumbing Code.

In areas where the average monthly temperature is above 30°F
(-1°C), a minimum temperature of 65°F (18°C) shall be
maintained.

Section 602.4. Occupiable work spaces. Indoor occupiable
work spaces shall be supplied with heat during the period from October
1 to May 1 to maintain a minimum temperature of 65°F (18°C)
during the period the spaces are occupied.

Processing, storage and operating areas that required cooling
or special temperature conditions.

Areas in which persons are primarily engaged in vigorous physical
activity.

Any person violating any of the provisions of this Article or
the National Property Maintenance Code adopted in this Article shall
be deemed guilty of an ordinance violation and upon conviction thereof
shall be fined in an amount not exceeding five hundred dollars ($500.00)
or be imprisoned in the City or County Jail for a period of not exceeding
ninety (90) days, or both such fine and imprisonment. Each day such
violation is committed or permitted to continue shall constitute a
separate offense and shall be punishable as such hereunder.
