There is hereby created the position
of City Counselor.

The City Counselor shall be appointed
by the Mayor, with the advice and approval of a majority of the members
of the City Council.

The City Counselor shall be an attorney
duly licensed by the State of Missouri to practice law. Election to
the position of City Attorney shall in no way disqualify a person
from also acting as City Counselor.

Exclusive of cases in the Municipal
Division of the Circuit Court, the City Counselor shall represent
the City in all other cases in all other courts of record in this
State, shall draft all ordinances and contracts and all other legal
forms of every kind, shall advise the Mayor, City Administrator, City
Council and its committees, and any other City Official, when requested,
upon all legal questions arising in the conduct of the business of
the City, shall attend the City Council meetings for the purpose of
giving the City Council any legal advice requested by its members
and perform such other duties as shall be prescribed by ordinance
or shall be ordered by the Council or the Mayor. The City Counselor
shall serve under the general day-to-day supervision of the City Administrator,
subject to instruction by the City Council.

The City Counselor shall receive
such compensation as the Council shall fix from time to time by ordinance.

A. Upon the recommendation of the City Counselor,
or in the case of sickness, absence from the City, interest of the
City Counselor in the proceedings adverse to the interest of the City
or other temporary inability of the City Counselor to discharge the
duties of his/her office, the City Council may, by resolution or ordinance,
employ such Special City Counselors as the City Council shall deem
appropriate. All Special City Counselors so employed shall be entitled
to receive a reasonable fee for their services as the City Council
may approved.
B. All Special City Counselors shall be employed
only with the approval of a majority of the members elected to the
City Council.
C. The Special City Counselors shall assist
the City Counselor or shall act instead of the City Counselor when
the City Counselor due to sickness, absence from the City, interest
of the City Attorney in the proceedings adverse to the interest of
the City, or is unable to discharge the duties of his/her office.
