A. A subdivision
plat subject to approval by the City's Commission or Board shall not
be submitted to any County Recorder for filing unless said subdivision
plat has endorsed upon it the approval of the Board, is signed by
the City Clerk, and has been stamped with the City Seal. No County
Recorder shall accept such a subdivision plat without such endorsement,
signature of the City Clerk, and City Seal.
B. No
owner or agent of the owner of land located within the City shall
knowingly transfer or with intent to defraud, transfer, sell, agree
to sell, or negotiate to sell that land by reference to or by other
use of a plat of any purported subdivision of the land before the
plat has been approved by the Board of Aldermen and recorded in the
office of the St. Louis County Recorder.
1. Any person violating the provisions of this Section shall forfeit
and pay to the City a penalty not to exceed three hundred dollars
($300.00) for each lot transferred or sold or agreed or negotiated
to be sold. The City may initiate legal action to enjoin or vacate
the transfer or sale or agreement and may recover the penalty in such
action.
2. The description of such lot or parcel by metes and bounds in the
instrument of transfer or other document used in the process of selling
or transferring shall not exempt the transaction from the provisions
of this Chapter.
C. The
Code Official shall not issue building permits for any structure located
on a lot in any subdivision, the plat of which was not approved in
accordance with regulations in effect at the time that lot was platted.
D. The
Board shall not permit any public improvements over which it has any
control to be made or any money expended for improvements on any land
that has been subdivided or upon any street that has been platted
unless such subdivision or street was approved in accordance with
the regulations which were in effect at the time the land was subdivided
or street platted.
E. The
subdivision regulations which were in effect governing that subdivision
at the time a particular preliminary plat of a subdivision was approved
shall be the regulations which shall govern that subdivision and be
enforced.
F. Any person violating the regulations of this Chapter, including any amendments thereto, but excepting the preceding Subsection
(B) of this Section, shall be guilty of a misdemeanor. Upon conviction thereof, such person shall be fined not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00), or imprisoned for no more than ninety (90) days, or both.
G. It
shall be the duty of the Planning Director to enforce the provisions
of this Chapter. However, any member of the department is hereby authorized
and directed to initiate appropriate proceedings to halt or prevent
violations of the Chapter.
