A. 
Every residence, residential unit, place of business, industry, or commerce, or other place providing goods or services of any type shall cooperate in the collection and recycling of garbage and combined refuse by performing according to this chapter.
B. 
The City of Fox Lake adopts and shall comply at all times with all applicable provisions of Ch. 287, Wis. Stats., and Ch. NR 544, Wis. Adm. Code.
C. 
The City of Fox Lake will provide continuing information and education on waste reduction, reuse and recycling to residents of single-family and two- to four-unit residences, youths, consumers, owners or managers of multiple-family residences and owners or managers of nonresidential facilities and properties.
D. 
The City of Fox Lake requires owners and designated agents of multiple-family dwellings to provide for recycling at their facilities of materials specified in § 287.07(3) and (4), Wis. Stats., as required by the recycling ordinance under § NR 544.06, Wis. Adm. Code.
E. 
The City of Fox Lake requires owners or designated agents of businesses and other nonresidential facilities to provide recycling services of materials specified in § 287.07(3) and (4), Wis. Stats., as required by the recycling ordinance under § NR 544.06, Wis. Adm. Code.
As used in this chapter, the following terms shall have the meanings indicated:
COLLECTOR
The person or persons specifically authorized by the Common Council to collect garbage, rubbish and recyclable materials and dispose of the same.
CONTAINER
The receptacle provided to each household (except those in buildings having more than four residential units) for collection of recyclable materials.
GARBAGE
Defined in § 289.01, Wis. Stats., as discarded materials resulting from the handling, processing, storage and consumption of food.
NEWSPAPERS
Matter printed on newsprint, including daily or weekly publications and advertising circulars, whether delivered separate or accompanying newspapers, normally delivered or mailed to a household or business for dissemination of public information, but excluding books, magazines, catalogs or similar publications.
NONRECYCLABLE MATERIAL
All pyrex glass, window glass, light bulbs, mirrors, broken glass and china, all styrofoam and melamine type plastics, all waxed paper, waxed cardboard, envelopes with gummed labels, glossy paper, magazines and envelopes with plastic windows and all other paper, garbage and rubbish, telephone directories, etc., not defined as recyclable material.
RECYCLABLE MATERIAL
Newspapers, brown, green and clear container glass, bimetal (tin) cans, aluminum cans, No. 1 and No. 2 plastic containers, corrugated cardboard, other nonglossy cardboard and, effective January 1, 1996, plastic containers labeled No. 3, No. 4, No. 5, No. 6 and No. 7 and foam polystyrene packing.
Except where otherwise provided herein, all residential recyclable material (except from buildings having more than four units) shall be placed on the curb for collection not more than 12 hours before the collection date. Curb placement shall be made in the containers, and the containers shall be removed from the curb not later than 12 hours following the pickup.
A. 
Recyclable materials. All recyclable materials shall be separated from other garbage and nonrecyclable material. The recyclable material from residential buildings having four or fewer units shall be grouped together and placed for collection in the container. Recyclable material shall be grouped together and separated from other garbage and refuse and shall consist of the following:
(1) 
Container glass. Brown, green and clear glass shall be unbroken, rinsed and have cover and labels removed and placed in the bin containing recyclable materials.
(2) 
Newspaper. All newspapers shall be tied in bundles or placed in paper bags and be kept dry so as not to render them useless as a recyclable item.
(3) 
Corrugated cardboard. All cardboard shall be flattened. Cardboard need not be bundled. Glossy cardboard is not included with recyclable materials.
(4) 
Aluminum cans. All aluminum cans shall be cleaned and rinsed and placed in the recycling bin.
(5) 
Plastic containers. All No. 1 and No. 2 plastic containers shall have the covers removed, be rinsed and flattened and placed in the recycling bin. Effective January 1, 1996, plastic containers labeled No. 3, No. 4, No. 5, No. 6 and No. 7 and foam polystyrene packing will be picked up. Containers should have the covers removed, rinsed and flattened.
(6) 
Bimetal (tin) cans. Steel, tin and aluminum combination cans shall be rinsed and labels removed.
(7) 
Major appliances. Residential/commercial air conditioners, clothes dryers, clothes washers, dishwashers, freezers, microwave ovens, refrigerators, stoves, residential and commercial furnaces, boilers, dehumidifiers and water heaters shall be placed at curb for pickup.
(8) 
Microwave ovens. Microwave ovens that have their capacitor removed may be disposed of with the garbage.
B. 
Items that are prohibited from improper disposal. As of January 1, 1995, no person may convert into fuel or burn with energy recovery at a solid waste treatment facility any of the following:
(1) 
Aluminum containers.
(2) 
Corrugated paper or other container board.
(3) 
Foam polystyrene packaging.
(4) 
Glass containers.
(5) 
Magazines or other material printed on similar paper.
(6) 
Newspapers or other material printed on newsprint.
(7) 
Office paper.
(8) 
Plastic containers.
(9) 
Steel containers.
(10) 
Containers for carbonated or malt beverages that are primarily made of a combination of steel and aluminum.
All recyclable material collected and deposited as provided in this chapter shall be the property of the City of Fox Lake.
All rules and regulations for the collection and disposal of recyclable materials shall be published in the same manner ordinances are published and after publication shall be in full force and effect.
The City may refuse to furnish collection service of the recyclable materials or of garbage or of nonrecyclable materials to any person not complying with this chapter and the rules and regulations promulgated by the Common Council for the collection of recyclable materials and the separation of recyclable materials.

A. 
Containers. All recyclables and garbage, offered for collection by the City, shall be in containers as directed by the Council, with the gross weight not to exceed 50 pounds.
B. 
Collection schedule and special regulations.
(1) 
Residential. All residential units, which consist of each single-family, mobile home, or multiple-family residential unit having four or fewer residential units designed for permanent living quarters, shall receive refuse and recyclable materials collection services as set forth in this chapter and in accordance with schedules determined by the Common Council. All garbage shall be picked up at the curb fronting any residence on a weekly basis. Each residential unit shall be billed for the service as a City utility on a monthly basis.
(2) 
Nonresidential waste. All refuse and recyclable materials produced by entities that are not residential units shall be collected and disposed of by the entity or by persons hired or contracted by the entity to perform such service. Entities other than industrial businesses (i.e. ,churches, synagogues, small commercial businesses, etc.) may participate in the City of Fox Lake residential waste program by written request to the City Clerk.
C. 
Garbage containers not to be left on curb. No material presented for collection by the City shall be put out more than 12 hours prior to the day of scheduled pickup, and any permanent containers shall be removed from the curb within 12 hours after the day of collection.
D. 
No nonresident dumping allowed.
(1) 
Generally. No person residing outside the City shall bring into the City for disposal any garbage, rubbish or other disposable items of a combustible or noncombustible nature.
(2) 
Exception. Subsection D(1) above does not pertain to use of refuse collection devices maintained by commercial establishments or the City for the incidental use of customers of such establishments or visitors to the City.
E. 
Fees for disposal and/or collection of refuse.
(1) 
Residential charges for refuse and recyclable materials collection and/or disposal shall be determined by resolution of the Common Council of the City of Fox Lake from time to time and shall be billed following service to each residential unit on a monthly municipal utility bill. The tenant of each residential unit as defined in this chapter shall receive a monthly bill for collection and disposal as determined by the City Clerk.
(2) 
Where home occupations are maintained in conjunction with a residential unit(s), they shall be deemed one residential unit for the purpose of this chapter and billing purposes.
(3) 
Delinquent charges. Any charges for refuse and recyclable materials collection and/or disposal which are delinquent by November 1 of the year shall be made a special assessment and lien against the real property to which the service was provided. When an account becomes 20 days delinquent, the City Clerk shall send a twenty-day delinquency notice to the tenant advising him that failure to pay the account shall result in assessment against the real property as set forth above. The administrative cost of the delinquency notice sent by the City Clerk shall be added to the delinquent bill as a one-percent monthly charge.
(4) 
Billing adjustment. An adjustment to the fee assessed for disposal and/or collection of refuse and recyclable materials shall be at the discretion of the Common Council of the City of Fox Lake. Written requests for adjustment of fees must be made to the City Clerk and presented to the Common Council for consideration.
A. 
Penalty options. It is within the discretion of the City of Fox Lake to use any of the penalty provisions separately or in conjunction as the City may deem necessary in dealing with a violation.
B. 
Penalty. The penalty for the violation of this chapter, in addition to refusal of service made hereunder, shall be a penalty as provided in § 1-4 of this Code. Each week in which a violation occurs shall be subject to a separate penalty.
C. 
Enforcement.
(1) 
The Chief of Police and officers of the City of Fox Lake Police Department shall enforce the provisions of this chapter and shall see that all violations thereof are promptly abated and violators prosecuted.
(2) 
The Director of Public Works shall promptly report to the Chief of Police, in writing, any violation of this chapter within the City which comes to his knowledge.
