The adoption of Megan's Law (Article 6-C of the Correction Law of the State of New York) has increased public awareness of sexual offenders by requiring them to become registered with authorities and making such information available to the public. The Town Board of the Town of Newstead enacts this chapter to prevent adult sex offenders from entering any Town park or Town bike path where children regularly meet and congregate. The Town Board of the Town of Newstead believes this legislation is necessary to further protect the best interests of children and disabled adults, and to protect the health, safety and welfare of residents within the Town of Newstead.
As used in this chapter, the following terms shall have the meanings indicated:
ADULT SEX OFFENDER
A person at least 18 years old, who has been convicted of a violation of a sexual offense upon a child under 17 years of age, and who has been designated as a level two or level three sexual offender pursuant to Article 6-C of the Correction Law of the State of New York.
CHILDREN
Persons under 18 years of age.
TOWN BIKE PATH
The bike path owned by the Town including all branches thereof.
TOWN PARK
Any public park owned by the Town where children are invited or congregate for the purpose of recreation, athletics and/or entertainment.
No adult sex offender shall be permitted to enter the Town park or the Town bike path.
No adult sex offender shall purchase, rent, lease or let a dwelling or other residential property or space in the Town of Newstead without first having notified the Newstead Town Clerk in writing of his or her current name and address. Any such person shall further notify the Newstead Town Clerk in the event his or her name or address changes, together with the new name and/or address.
Violation of this chapter shall be a Class A misdemeanor, punishable by a fine of up to $500 and 15 days' imprisonment for a first offense, and by a fine of up to $1,000 and six months' imprisonment for a second or further offense. This chapter may be enforced by any police officer or peace officer with jurisdiction within the Town. In addition, the Town may bring an action in the Supreme Court of the State of New York to enjoin violation of this chapter.
