This chapter shall be known as the "Upper Providence Township
Recycling Ordinance."

There is hereby established a program for the mandatory separation
and collection of recyclable materials from solid waste, as set forth
herein, from residential and commercial premises within the Township.

As used in this chapter:
(a) ALUMINUM CANS — Means empty all-aluminum beverage and food
containers.
(b) BIMETALLIC CANS — Means empty food or beverage containers consisting
of ferrous sides and bottom and an aluminum top.
(c) CLEAR GLASS — Means all empty bottles and jars made of clear
or transparent glass, except noncontainer glass or plate glass.
(d) COLORED GLASS — Means all empty bottles and jars made of green
or brown glass, except noncontainer glass, plate glass, blue glass
and porcelain and ceramic products.
(e) COMMERCIAL ESTABLISHMENTS — Means those premises used primarily
for commercial and/or industrial purposes, as such terms are commonly
defined and as defined by the Zoning Code of the Township.
(f) CORRUGATED PAPER — Means cardboard or paperboard such as is
used in the manufacture of folding paper cartons, set-up boxes and
similar boxboard products, as further defined or limited by regulation.
(g) CURBSIDE RECYCLING COLLECTION — Means the scheduled collection
and transport of recyclable material placed at curbside, subject to
this chapter.
(h) HIGHGRADE OFFICE PAPER — Means a sorted mixture of various
qualities of papers containing less than 10% of groundwood stock,
coated or uncoated, as further defined or limited by regulation.
(i) INSTITUTIONAL ESTABLISHMENTS — Means those facilities that
house or serve groups of people, such as hospitals, schools and nursing
homes.
(j) MULTIFAMILY DWELLINGS — Means any premises having four or more
separate dwelling units per structure.
(k) MUNICIPAL ESTABLISHMENT — Means any establishment operated
or used by a city, borough, incorporated town, township or county,
or any authority created by any one or more of the foregoing.
(l) NEWSPAPERS — Means paper of the type commonly referred to as
"newsprint" and distributed at fixed intervals, usually daily or weekly,
having printed thereon news and other matters of public interest,
but not including glossy advertising, inserts or magazines.
(m) PERSON(S) — Means any individual, partnership, corporation,
association, institution, cooperative enterprise, municipal authority
or any other legal entity whatsoever, owning, leasing or occupying
a residential dwelling or commercial or institutional establishment.
(n) PLASTIC BOTTLES — Means empty plastic bottles graded as #1
and #2 previously containing potable liquids or laundry products.
(o) PLASTICS — Means empty plastic food and beverage containers
and/or such other items as are made with plastic.
(p) RECYCLABLE MATERIALS or RECYCLABLES — Means those materials
specified by ordinance of Council to be recycled. Council hereby designates
clear glass, green glass, brown glass, bimetallic cans, aluminum cans,
newspapers and plastic bottles as recyclable materials and recyclables.
(q) RESIDENTIAL DWELLING — Means any occupied dwelling having three
or fewer dwelling units per structure.
(r) SOLID WASTE — Means all garbage, refuse and other materials defined as "Municipal solid waste" pursuant to Chapter
1064.

food containers.

Recyclable materials from residential dwellings shall be placed
at the curb, separate from solid waste, for collection at such times
and on such days as may be herein or hereafter established by Township
resolution. Such resolutions shall schedule a minimum of one day per
month for the pick-up of recyclables from residential dwellings. Recyclables
shall be placed at the curbside in containers of such design and in
such manner as required by Township resolution. In the event that
the Township provides containers to owners, lessees and occupiers
of residential dwellings, such persons shall use such containers and
separate recyclables within such containers as required by Township
resolution. Newspapers shall be tied both across and lengthwise in
manageable bundles or placed in paper kraft (shopping) bags, and shall
be kept dry.

(a) The owner, landlord or an agent of the owner or landlord of multifamily
dwellings, the solid waste of which is not collected by the Township,
shall establish a collection system for recyclable materials at each
property. The particular collection system established for a multifamily
dwelling must contain suitable containers for collecting and sorting
recyclable materials, easily accessible locations for such containers
and written instructions provided to the occupants of the multifamily
dwelling concerning the use and availability of the collection system.
Owners, landlords and agents of owners and landlords who comply with
this chapter shall not be liable for the compliance herewith by occupants
of their buildings.
(b) Owners, landlords or agents of owners of multifamily dwellings shall make separate arrangements for the collection and transfer of recyclables to a recycling system. All collectors must comply with Chapter
1060 (Licensing of Solid Waste Collectors). The owner or landlord of a multifamily dwelling, or the agent thereof, shall provide written documentation to the Township, annually, in accordance with Township resolution, including, but not limited to, a summary of the separation, collection and transfer systems for recyclables used during the year and the total number of tons recycled.

Commercial, industrial and Municipal establishments shall separate
and store, until collection, high-grade office paper, aluminum, corrugated
paper, newspapers, clear glass and colored glass. These establishments
must arrange for the transfer of these materials to a recycling system.
Such establishments shall provide annually to the Township written
documentation, in accordance with Township resolution, including,
but not limited to, a summary of the separation, collection and transfer
systems of recyclables used during the year and the total number of
tons recycled.

(a) It shall be a violation of this chapter for any person(s), unauthorized to do so by the Township pursuant to this chapter, to collect or pick-up, or cause to be collected or picked-up, any recyclable material or any waste or refuse. Each such collection in violation hereof shall constitute a separate and distinct offense punishable under Section
1066.99.
(b) From the time of placement of recyclables at the curb for collection
in accordance with the provisions hereof and/or of Township resolution,
such recyclables shall be the property of the Township or its designee.
As set forth above, it shall be a violation of this chapter for any
unauthorized person to collect, remove or dispose of, or to cause
to be collected, removed or disposed of, any recyclables.

Nothing in this chapter shall be construed to prevent, penalize
or otherwise make illegal the donation or sale of recyclables to any
person, partnership, corporation or charitable entity, provided, however,
that such donated or sold recyclables shall be placed at curbside
for pick-up by the donee or vendee.

The Township Manager and his or her designee is hereby authorized
and directed to enforce this chapter. The Township Manager is hereby
authorized and directed to establish and promulgate reasonable regulations
as to the manner, materials, days and times for the collection of
recyclable materials in accordance with the terms hereof, and any
other matters required to implement this chapter. The Township Manager
or his or her designee may change, modify, repeal or amend any portion
of said rules and regulations at any time.

The Township may enter into an agreement or agreements with public or private agencies or firms to authorize them to collect all or part of recyclable materials from the curbside. The Township is hereby authorized to enter into a single agreement, if it deems doing so advisable, for the collection of recyclables and solid waste by one collector. The fees for the collection of recyclables shall be billed, paid, collected and liened as provided in Section
1062.09.

Whenever the requirements of this chapter are in conflict with
other requirements of the ordinances of the Township, those imposing
the highest standard shall govern.
